  1. LIMITED WARRANTY

M Series, A Series & STIL for United States and Canada

Bullfrog International, LC (“Bullfrog” or “we”) extends the following coverage under this Limited Warranty solely to the original end-user purchaser (“Owner” or “you”) of any 2023 model year and later M Series, A Series or STIL Bullfrog Spas hot tub manufactured on or after February 1, 2023 and installed for residential use in the United States or Canada.

LIFETIME WARRANTY

ENDURAFRAME™

Bullfrog warrants the EnduraFrame (injection-molded spa frame) against degradation for the life of the original retail purchaser of the spa.

10 YEAR WARRANTY

SHELL STRUCTURE

Bullfrog warrants the Bullfrog Spa shell will not leak for ten years from the original spa purchase date.

7 YEAR WARRANTY

SHELL SURFACE

Bullfrog warrants the surface finish of the Bullfrog Spa will not crack, craze wrinkle, blister, peel or delaminate for seven years from the original spa purchase date.

5 YEAR WARRANTY

EQUIPMENT

This warranty specifically covers the pump(s), heater, control system, Snap Caps™, FilterCap™, other Bullfrog mechanical equipment (excluding any equipment listed in other sections), and leaks from any component or plumbing fitting located beneath the spa shell.

Electrical and mechanical equipment with its associated piping and fittings are warranted against defects in materials and workmanship for five years from purchase date.

Defective components that are easily removed from the spa and that can be readily replaced by the customer and do not require specialized tools or knowledge or create personal safety issues, all of which are referred to as “Easily Removed Components,” will be repaired or replaced free of charge at your authorized Bullfrog Spas dealer or retail store or by sending the defective component(s) to Bullfrog. This warranty excludes audio systems, water care systems, and the interior and exterior spa lighting systems.

SPA CABINET and BASE

This warranty specifically covers the cabinet corners, door and side panels, and the molded spa base.

Cabinet sections (corners, doors, side panels) are warranted against material degradation and cracking for five years from purchase date.

JETPAK THERAPY SYSTEM®
This warranty specifically covers the jets, any leaks from JetPak jet fittings, and the JetPak manifold system.
The JetPak manifold system is warranted for five years from purchase date.

Color availability on replacement and aftermarket JetPaks may vary and will depend upon market demand and availability of the color to Bullfrog.

3 YEAR WARRANTY

PATIO PERFORMANCE™ SPA COVER
Bullfrog warrants the Patio Performance spa cover against defects in materials or workmanship, unless determined to be normal fading or wear, for three years from the original spa purchase date.

1 YEAR WARRANTY

LIGHTING SYSTEMS
Bullfrog warrants the interior and exterior spa lighting systems against defects in materials and workmanship for one year from the original spa purchase date. Lighting components that are Easily Removed Components, such as exterior sconce lights, will be repaired or replaced free of charge at your authorized Bullfrog Spa dealer or retail store or by sending the defective component(s) to Bullfrog.
AUDIO SYSTEMS
Bullfrog warrants audio systems against defects in materials and workmanship for one year from the original spa purchase date.
WATER CARE SYSTEMS
Bullfrog warrants water care systems against defects in materials and workmanship for one year from the original spa purchase date.

OTHER WARRANTIES

Bullfrog warrants the Bullfrog Spa pillows, metal jet faces, and filters against defects in materials and workmanship through time of delivery.

WARRANTY PERFORMANCE and TERMS

Bullfrog or its authorized agent (i.e., personnel of Bullfrog, its retail dealers, or its authorized third-party service companies) will repair or replace any malfunctioning or defective component on the spa that is covered under the terms of this Limited Warranty and was purchased from an authorized Bullfrog Spas dealer or retail store. Bullfrog reserves the right, at its option, to either repair or replace a defective spa or component. Owner is required to maintain clear access for spa repairs and is responsible for any non-standard costs of accessing spa equipment or spa plumbing. When warranty service requires removal of the spa, Owner will be responsible for any non-standard costs of spa removal and replacement, such as for spas located in a vault, spas located on an upper deck where a crane is required, or repair or replacement of decking or surrounding stone or concrete.
If a replacement spa or component is provided by Bullfrog, Owner will be responsible for all costs for removal and replacement of the defective product, mileage charges, shipping costs of the replacement product, and delivery. In the event of a structure or frame failure after seven years from the original spa purchase date, the defective spa must be sent to Bullfrog for repair at Owner’s expense. In some situations, the servicing dealer or Bullfrog may charge Owner a reasonable service fee.
Bullfrog reserves the right to use either new or reconditioned replacement components. Any repair or replacement component or spa does not receive new or extended warranty coverage but is covered only under the remaining portion of the original product’s warranty term.
Bullfrog’s Lifetime warranties last for the lifetime of the original retail purchaser of the spa. If the original retail purchaser is a company or entity rather than a natural person (e.g., corporation, limited liability company, family trust, etc.), “life of the original retail purchaser” shall mean ten years.
To obtain warranty service, contact your authorized Bullfrog Spas dealer or Bullfrog and submit proof of purchase. The proof of purchase requirement may be waived if Bullfrog’s or the dealer’s records can confirm the original spa purchase date and that you are the original purchaser. Any defective spa or component sent directly to the factory for warranty repair must be preauthorized by Bullfrog and must be freight prepaid. Return freight will be paid by Bullfrog on all warranted components and spas, except that Owner is responsible for all shipping charges for any spa returned for repairs more than seven years after its purchase date. When the entire spa is sent to the factory for repair, all costs of removing and re-installing the spa at Owner’s location will be the responsibility of Owner. Repair or replacement, as described above, shall be Bullfrog’s sole liability for any breach of this Limited Warranty.

EXCLUSIONS

This Bullfrog Spa Limited Warranty is void in the following circumstances:
▪ The spa has been subject to neglect, misuse or abuse, or to alterations that cause the damage.
▪ Damage is caused by repair or maintenance work that has been attempted or done by anyone other than an authorized agent of Bullfrog.
▪ The spa has been used in a non-residential or commercial location (including where a spa may be used by multiple residents of an apartment or townhome complex) or in any way for which it was not designed.
▪ Damage is caused by an act of God (fire, earthquake, hail, etc.) or any other cause beyond the control of Bullfrog.
▪ Damage is caused by the addition or use of any non-approved mechanical or electrical component, or chemical substance.
▪ Damage is caused by shipping, moving, mishandling, improper installation or electrical hook-up by someone other than an authorized agent of Bullfrog.
▪ Damage to the spa shell is caused by excessive heat build-up due to failure to properly cover the spa when it is empty of water or exposed to direct sunlight or other weather conditions.
▪ Damage is caused by operating the spa outside the water temperature range of 40°F – 110°F (4°C-43°C).
▪ Damage is caused by improper maintenance of spa water chemistry or by allowing undissolved spa chemicals to lie on the spa’s surface.
▪ Damage is caused by failure to install, maintain and operate the spa in accordance with the recommendations contained in the Bullfrog Owner’s Manual, Pre-Delivery Guide or any other printed instructions, notice or bulletin from Bullfrog.
▪ Damage is caused by failure to provide a proper spa foundation as described in the Pre-Delivery Guide. Any person or company may perform necessary maintenance or repairs on a Bullfrog spa. However, any damages caused by you or anyone other than Bullfrog or its authorized agents are not covered and may void this Limited Warranty.

LIMITATIONS

THIS LIMITED WARRANTY STATES BULLFROG’S SOLE LIABILITY AND OBLIGATION FOR ANY SPA PROBLEMS OR MALFUNCTIONS AND FOR ANY WARRANTY BREACHES. THIS LIMITED WARRANTY TAKES THE PLACE OF ALL OTHER WARRANTIES, INCLUDING ANY EXPRESS OR STATUTORY WARRANTIES. ANY IMPLIED WARRANTIES (SUCH AS IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) ARE LIMITED TO THE STATUTORY PERIOD OR THE DURATION OF THE APPLICABLE WARRANTY STATED ABOVE, WHICHEVER IS SHORTER. NO AGENT, DEALER, DISTRIBUTOR, SERVICE COMPANY OR OTHER PARTY IS AUTHORIZED TO CHANGE, MODIFY OR EXTEND THE TERMS OF THIS LIMITED WARRANTY IN ANY MANNER WHATSOEVER. THIS LIMITED WARRANTY TERMINATES UPON TRANSFER OF SPA OWNERSHIP. BULLFROG MAY, AT ITS OPTION, EITHER REPAIR OR REPLACE A DEFECTIVE PRODUCT (SPA OR A COMPONENT). IF THE SPA NEEDS TO BE REPLACED BUT THE CURRENT MARKET PRICE OF THE REPLACEMENT SPA IS GREATER THAN THE ORIGINAL SPA’S MARKET PRICE, OWNER WILL BE REQUIRED TO EITHER PAY AN UPGRADE FEE OR CHOOSE A REPLACEMENT SPA COMPARABLE TO THE MARKET PRICE OF THE ORIGINAL SPA AT THE TIME OF ITS PURCHASE. THE ORIGINAL WARRANTY PERIOD WILL CONTINUE TO APPLY TO ALL REPAIRED AND REPLACEMENT SPAS AND COMPONENTS AND WILL NOT BE RENEWED OR EXTENDED FOR ANY REASON.

DISCLAIMERS

EXCEPT AS SET FORTH IN THIS LIMITED WARRANTY OR OTHERWISE REQUIRED BY APPLICABLE LAW, BULLFROG AND ITS AUTHORIZED AGENTS SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, DEATH, DAMAGES TO PROPERTY, LOSS, COST OR OTHER DAMAGE, WHETHER DIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE, ARISING OUT OF THE SPAS, BULLFROG’S OR ITS AGENTS’ SERVICES, OR ANY DEFECT COVERED BY THIS LIMITED WARRANTY, INCLUDING WITHOUT LIMITATION LOSS OF USE OF THE SPA AND COST FOR REMOVAL OF DEFECTIVE PRODUCTS, EVEN IF BULLFROG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS REQUIRED BY LAW, THE TOTAL LIABILITY OF BULLFROG AND ITS AUTHORIZED AGENTS TO YOU OR THIRD PARTIES SHALL NOT EXCEED THE ORIGINAL AMOUNT PAID FOR THE DEFECTIVE PRODUCT.

LEGAL RIGHTS

This Limited Warranty gives you specific legal rights. You may also have other rights under the laws of your country, state, or province. Some jurisdictions do not allow limitations on certain implied or statutory warranties or other warranty terms and conditions, so these limitations may not apply to you. Prompt return of a completed warranty registration form will help protect your warranty rights. Registration requirements do not apply to residents of California or other
jurisdictions where prohibited by law.

Bullfrog reserves the right, at its option, to either repair or replace a defective spa or component. Owner is required to maintain clear access for spa repairs and is responsible for any non-standard costs of accessing spa equipment or spa plumbing.

As Swim Series spas are large and often require complex and/or expensive installation methods and accommodations, all reasonable efforts will be made to repair or replace components on site where the spa is installed. If Bullfrog or its authorized agent determines that onsite repair of the defect or replacement of components is not feasible due to limitations created by the spa installation location, we reserve the right to require removal of the spa from its installation location to ensure safe technician access. In such an event, costs for moving the spa to a workable location and reinstallation of the spa after repairs will be the sole responsibility of Owner, including any non-standard costs of spa removal and replacement, such as for spas located in a vault, spas located on an upper deck where a crane is required, or repair or replacement of decking or surrounding stone or concrete. In the rare case that a replacement spa is required to adequately address the defect or malfunction, Owner will be solely responsible for removal costs, shipping costs of the replacement product, and delivery costs to the installation location.

3 YEAR WARRANTY

SHELL SURFACE
Bullfrog warrants the surface finish of the Bullfrog Spa will not crack, craze wrinkle, blister, peel or delaminate for three years from the original spa purchase date.
EQUIPMENT
This warranty specifically covers the pump(s), heater, control system, FilterCap™, other Bullfrog mechanical equipment (excluding any equipment listed in other sections), and leaks from any component or plumbing fitting located beneath the spa shell.
Electrical and mechanical equipment with its associated piping and fittings are warranted against defects in materials and workmanship for three years from purchase date. Defective components that are easily removed from the spa and that can be readily replaced by the customer and do not require specialized tools or knowledge or create personal safety issues, all of which are referred to as “Easily Removed Components,” will be repaired or replaced free of charge at your authorized Bullfrog Spas dealer or retail store or by sending the defective
component(s) to Bullfrog. This warranty excludes audio systems, water care systems, and the interior and exterior spa lighting systems.
SPA CABINET
This warranty specifically covers the cabinet corners, door and side panels.
Cabinet sections (corners, doors, side panels) are warranted against material degradation and cracking for three years from purchase date.
PATIO PERFORMANCE™ SPA COVER
Bullfrog warrants the Patio Performance spa cover against defects in materials or workmanship, unless determined to be normal fading or wear, for three years from the original spa purchase date.

1 YEAR WARRANTY

LIGHTING SYSTEMS
Bullfrog warrants the interior and exterior spa lighting systems against defects in materials and workmanship for one year from the original spa purchase date. Lighting components that are Easily Removed Components, such as exterior sconce lights, will be repaired or replaced free of charge at your authorized Bullfrog Spa dealer or retail store or by sending the defective component(s) to Bullfrog.
AUDIO SYSTEMS
Bullfrog warrants audio systems against defects in materials and workmanship for one year from the original spa purchase date.
WATER CARE SYSTEMS
Bullfrog warrants water care systems against defects in materials and workmanship for one year from the original spa purchase date.

OTHER WARRANTIES

Bullfrog warrants the Bullfrog Spa pillows, metal jet faces, and filters against defects in materials and workmanship through time of delivery.


WARRANTY PERFORMANCE and TERMS

Bullfrog or its authorized agent (i.e., personnel of Bullfrog, its retail dealers, or its authorized third-party service companies) will repair or replace any malfunctioning or defective component on the spa that is covered under the terms of this Limited Warranty and was purchased from an authorized Bullfrog Spas dealer or retail store. Bullfrog reserves the right, at its option, to either
repair or replace a defective spa or component. Owner is required to maintain clear access for spa repairs and is responsible for any non-standard costs of accessing spa equipment or spa plumbing. When warranty service requires removal of the spa, Owner will be responsible for any non-standard costs of spa removal and replacement, such as for spas located in a vault, spas located on an upper deck where a crane is required, or repair or replacement of decking or
surrounding stone or concrete.
If a replacement spa or component is provided by Bullfrog, Owner will be responsible for all costs for removal and replacement of the defective product, mileage charges, shipping costs of the replacement product, and delivery. In the event of a structure or frame failure after seven years from the original spa purchase date, the defective spa must be sent to Bullfrog for repair at
Owner’s expense. In some situations, the servicing dealer or Bullfrog may charge Owner a reasonable service fee.
Bullfrog reserves the right to use either new or reconditioned replacement components. Any repair or replacement component or spa does not receive new or extended warranty coverage but is covered only under the remaining portion of the original product’s warranty term.

To obtain warranty service, contact your authorized Bullfrog Spas dealer or Bullfrog and submit proof of purchase. The proof of purchase requirement may be waived if Bullfrog’s or the dealer’s records can confirm the original spa purchase date and that you are the original purchaser. Any defective spa or component sent directly to the factory for warranty repair must be preauthorized by Bullfrog and must be freight prepaid. Return freight will be paid by Bullfrog on all warranted components and spas, except that Owner is responsible for all shipping charges for any spa returned for repairs more than seven years after its purchase date. When the entire spa is sent to the factory for repair, all costs of removing and re-installing the spa at Owner’s location will be the responsibility of Owner. Repair or replacement, as described above, shall be Bullfrog’s sole liability for any breach of this Limited Warranty.

 

EXCLUSIONS

This Bullfrog Spa Limited Warranty is void in the following circumstances:
▪ The spa has been subject to neglect, misuse or abuse, or to alterations that cause the damage.
▪ Damage is caused by repair or maintenance work that has been attempted or done by anyone other than an authorized agent of Bullfrog.
▪ The spa has been used in a non-residential or commercial location (including where a spa may be used by multiple residents of an apartment or townhome complex) or in any way for which it was not designed.
▪ Damage is caused by an act of God (fire, earthquake, hail, etc.) or any other cause beyond the control of Bullfrog.
▪ Damage is caused by the addition or use of any non-approved mechanical or electrical component, or chemical substance.
▪ Damage is caused by shipping, moving, mishandling, improper installation or electrical hook-up by someone other than an authorized agent of Bullfrog.
▪ Damage to the spa shell is caused by excessive heat build-up due to failure to properly cover the spa when it is empty of water or exposed to direct sunlight or other weather conditions.
▪ Damage is caused by operating the spa outside the water temperature range of 40°F-110°F (4°C-43°C).
▪ Damage is caused by improper maintenance of spa water chemistry or by allowing undissolved spa chemicals to lie on the spa’s surface.
▪ Damage is caused by failure to install, maintain and operate the spa in accordance with the recommendations contained in the Bullfrog Owner’s Manual, Pre-Delivery Guide or any other printed instructions, notice or bulletin from Bullfrog.
▪ Damage is caused by failure to provide a proper spa foundation as described in the Pre-Delivery Guide.
Any person or company may perform necessary maintenance or repairs on a Bullfrog spa. However, any damages caused by you or anyone other than Bullfrog or its authorized agents are not covered and may void this Limited Warranty.


LIMITATIONS

THIS LIMITED WARRANTY STATES BULLFROG’S SOLE LIABILITY AND OBLIGATION FOR ANY SPA PROBLEMS OR MALFUNCTIONS AND FOR ANY WARRANTY BREACHES. THIS LIMITED WARRANTY TAKES THE PLACE OF ALL OTHER WARRANTIES, INCLUDING ANY EXPRESS OR STATUTORY WARRANTIES. ANY IMPLIED WARRANTIES (SUCH AS IMPLIED WARRANTIES OF MERCHANTABILITY
AND FITNESS FOR A PARTICULAR PURPOSE) ARE LIMITED TO THE STATUTORY PERIOD OR THE DURATION OF THE APPLICABLE WARRANTY STATED ABOVE, WHICHEVER IS SHORTER. NO AGENT, DEALER, DISTRIBUTOR, SERVICE COMPANY OR OTHER PARTY IS AUTHORIZED TO CHANGE, MODIFY OR EXTEND THE TERMS OF THIS LIMITED WARRANTY IN ANY MANNER WHATSOEVER. THIS LIMITED WARRANTY TERMINATES UPON TRANSFER OF SPA OWNERSHIP. BULLFROG MAY,
AT ITS OPTION, EITHER REPAIR OR REPLACE A DEFECTIVE PRODUCT (SPA OR A COMPONENT). IF THE SPA NEEDS TO BE REPLACED BUT THE CURRENT MARKET PRICE OF THE REPLACEMENT SPA IS GREATER THAN THE ORIGINAL SPA’S MARKET PRICE, OWNER WILL BE REQUIRED TO EITHER PAY AN UPGRADE FEE OR CHOOSE A REPLACEMENT SPA COMPARABLE TO THE MARKET PRICE OF THE ORIGINAL SPA AT THE TIME OF ITS PURCHASE. THE ORIGINAL WARRANTY PERIOD WILL CONTINUE TO APPLY TO ALL REPAIRED AND REPLACEMENT SPAS AND COMPONENTS AND WILL NOT BE RENEWED OR EXTENDED FOR ANY REASON.
DISCLAIMERS EXCEPT AS SET FORTH IN THIS LIMITED WARRANTY OR OTHERWISE REQUIRED BY APPLICABLE LAW, BULLFROG AND ITS AUTHORIZED AGENTS SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, DEATH, DAMAGES TO PROPERTY, LOSS, COST OR OTHER DAMAGE, WHETHER DIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE, ARISING OUT OF THE SPAS, BULLFROG’S OR ITS AGENTS’ SERVICES, OR ANY DEFECT COVERED BY THIS LIMITED WARRANTY, INCLUDING WITHOUT LIMITATION LOSS OF USE OF THE SPA AND COST FOR REMOVAL OF DEFECTIVE PRODUCTS, EVEN IF BULLFROG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS REQUIRED BY LAW, THE TOTAL LIABILITY OF BULLFROG AND ITS AUTHORIZED AGENTS TO YOU OR THIRD PARTIES SHALL NOT EXCEED THE ORIGINAL AMOUNT PAID FOR THE
DEFECTIVE PRODUCT.

This Limited Warranty gives you specific legal rights. You may also have other rights under the laws of your country, state, or province. Some jurisdictions do not allow limitations on certain implied or statutory warranties or other warranty terms and conditions, so these limitations may not apply to you. Prompt return of a completed warranty registration form will help protect your warranty rights. M Series, A Series & STIL for European Union & United Kingdom Bullfrog International, LC (“Bullfrog” or “we”) extends the following coverage under this Limited Warranty solely to the original end-user purchaser (“Owner” or “you”) of any M Series, A Series or STIL spa manufactured on or after January 1, 2025 and installed for residential use in European Union and the United Kingdom.

Electrical and mechanical equipment with its associated piping and fittings are warranted against defects in materials and workmanship for five years from purchase date.
Defective components that are easily removed from the spa and that can be readily replaced by the customer and do not require specialized tools or knowledge or create personal safety issues, all of which are referred to as Easily Removed Components, will be repaired or replaced free of charge at your
authorized Bullfrog Spas dealer. This warranty excludes audio systems, water care systems, and interior and exterior spa lighting systems.

JETPAK THERAPY SYSTEM®
This warranty specifically covers the jets, any leaks from JetPak jet fittings, and the JetPak manifold system.
JetPak manifold system is warranted for five years from purchase date.
Color availability on replacement and aftermarket JetPaks may vary and will depend upon market demand and availability of the color to Bullfrog.

Owner is required to maintain clear access to the spa equipment bay and is responsible for any non-standard costs of accessing spa equipment. If Bullfrog or its authorized agent determines that repairing the defect is not feasible, Bullfrog or its authorized agent may instead provide a replacement spa or component equal in value to the defective spa or component. In cases where a replacement spa is authorized, Bullfrog will attempt to replace the spa with one of equal market value. If authorized by Bullfrog, you may also be allowed to choose a higher-priced spa by paying the difference between the market value of your original spa at the time of purchase and the current market price of the new replacement spa.
Owner will be responsible for any non-standard costs of spa removal and replacement, such as spas located in a vault, spas located on a balcony or deck where a crane is required, or decking repair or replacement. After six months from the original spa purchase date, Owner will be responsible for all costs for removal and replacement of the defective product, dealer mileage charges, shipping costs of replacement product, and delivery. In the event of a structure or frame failure after three years from the original spa purchase date, the defective spa must be sent to your authorized Bullfrog Spa dealer for repair at the Owner’s expense. In some situations, the servicing dealer or Bullfrog may
charge Owner a reasonable service fee.

To the maximum extent permitted by applicable law, repair or replacement, as described above, shall be Bullfrog’s sole liability and your sole and exclusive remedy for any breach of this Limited Warranty.

ARE EXPRESSLY EXCLUDED. NOTHING IN THIS LIMITED WARRANTY EXCLUDES BULLFROG’S LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY BULLFROG’S NEGLIGENCE, FRAUD OR FRAUDULENT MISREPRESENTATION, AND ANY OTHER LIABILITY WHICH CANNOT BE EXCLUDED BY LAW. EXCEPT AS SET FORTH IN THIS LIMITED WARRANTY OR OTHERWISE REQUIRED BY APPLICABLE LAW, BULLFROG AND ITS AUTHORIZED AGENTS SHALL NOT BE LIABLE FOR: (A) ANY PERSONAL INJURY,
DEATH, OR DAMAGES TO PROPERTY; OR (B) ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE, LOSSES OR COSTS, ARISING OUT OF THE SPAS, BULLFROG’S OR ITS AGENTS’ PRODUCTS OR SERVICES, OR ANY DEFECT COVERED BY THIS LIMITED WARRANTY, INCLUDING WITHOUT LIMITATION, LOSS OF USE OF THE SPA AND COST FOR REMOVAL OF DEFECTIVE PRODUCTS, EVEN IF
BULLFROG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS REQUIRED BY LAW, THE TOTAL LIABILITY OF BULLFROG AND ITS AUTHORIZED AGENTS TO YOU OR THIRD PARTIES ARISING OUT OF OR IN CONNECTION WITH THIS LIMITED WARRANTY, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY OR OTHERWISE SHALL NOT EXCEED THE ORIGINAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT. COVERAGE UNDER THIS LIMITED WARRANTY SHALL COMMENCE ON THE ORIGINAL DATE
OF PURCHASE AND WILL NOT EXTEND FOR ANY REASON WHATSOEVER BEYOND THE STATED TIME PERIOD(S).


LEGAL RIGHTS CONSUMERS

The following applies only if you qualify as a consumer. This Limited Warranty gives you specific legal rights in addition to your statutory rights under applicable consumer protection laws. These statutory rights may vary depending on the laws of your country of residence and are not affected by this
warranty.
Some jurisdictions do not allow limitations on, or exclusions of, certain implied terms and conditions, or liabilities. In those cases, this Limited Warranty does not affect, limit or exclude any statutory rights you may have. Prompt return of a completed warranty registration form will help protect your warranty rights. Registration requirements do not apply to residents of jurisdictions where prohibited by law.

GENERAL

Rights of Third Parties

A person who is not party to this Limited Warranty may not enforce any term of this Limited Warranty under the Contracts (Rights of Third Parties) Act 1999.


Invalidity

If a competent court or administrative body finds that any provision of this Limited Warranty is invalid illegal or unenforceable, it will be excluded from the warranty and the rest of this Limited Warranty
shall remain unaffected and in force.

Assignment

You may not assign, transfer, mortgage, charge, subcontract, delegate, declare a trust over or deal in
any other manner with any of your rights and obligations under this Limited Warranty.


GOVERNING LAW AND JURISDICTION


This Limited Warranty, and any non-contractual obligations arising from or connected with this Limited Warranty, is governed by and construed under Dutch law, without prejudice to any rights you may have under applicable mandatory laws. You and Bullfrog irrevocably agree that the court of
Amsterdam have exclusive jurisdiction to settle any dispute (whether contractual or non-contractual) arising out of or in connection with this Limited Warranty, including as to its existence, validity or termination, unless mandatory applicable laws grant you the right to opt for dispute resolution by a court that would otherwise have jurisdiction under the applicable law.

Lighting components that are Easily Removed Components, such as the exterior sconce lights, will be repaired or replaced free of charge at your authorized Bullfrog Spa dealer.
AUDIO SYSTEMS
Bullfrog warrants audio systems against defects in materials and workmanship for two years from the original spa purchase date.
WATER CARE SYSTEMS
Bullfrog warrants water care systems against defects in materials and workmanship for two years from the original spa purchase date.

OTHER WARRANTIES

Bullfrog warrants the Bullfrog Spa pillows, metal jet faces, and filters against defects in materials and workmanship at the time of delivery.

WARRANTY PERFORMANCE and TERMS

Bullfrog or its authorized agent (i.e., personnel of Bullfrog, its retail dealers, or its authorized third party service companies) will repair or replace any malfunctioning or defective component on the Bullfrog spa that is covered under the terms of this Limited Warranty and was purchased from an authorized Bullfrog Spas dealer or retail store. In doing so, Bullfrog reserves the right, at its option, to either repair or replace the defective spa or component. Owner is required to maintain clear access to the spa equipment bay and is responsible for any non-standard costs of accessing spa equipment.
If Bullfrog or its authorized agent determines that repairing the defect is not feasible, Bullfrog or its authorized agent may instead provide a replacement spa or component equal in value to the defective spa or component. In cases where a replacement spa is authorized, Bullfrog will attempt to replace the spa with one of equal market value. If authorized by Bullfrog, you may also be allowed to
choose a higher-priced spa by paying the difference between the market value of your original spa at the time of purchase and the current market price of the new replacement spa.
Owner will be responsible for any non-standard costs of spa removal and replacement, such as spas located in a vault, spas located on a balcony or deck where a crane is required, or decking repair or replacement. After six months from the original spa purchase date, Owner will be responsible for all costs for removal and replacement of the defective product, dealer mileage charges, shipping costs of replacement product, and delivery. In the event of a structure or frame failure after three years from the original spa purchase date, the defective spa must be sent to your authorized Bullfrog Spa dealer for repair at the Owner’s expense. In some situations, the servicing dealer or Bullfrog may
charge Owner a reasonable service fee.
Bullfrog reserves the right to use either new or reconditioned replacement components. Any repair or replacement component or spa does not receive new or extended warranty coverage but is covered only under the remaining portion of the original product’s warranty term.
To obtain warranty service, contact your authorized Bullfrog Spas dealer and submit proof of purchase. The proof of purchase requirement may be waived if Bullfrog’s or the dealer’s records can confirm the original spa purchase date and that you are the original purchaser. Any defective spa or component sent directly to the dealer for warranty repair must be pre-authorized by the dealer or  Bullfrog and must be freight prepaid. Return freight will be paid by Bullfrog on all warranted components and spas, excluding any spa returned that is more than three years after its purchase date. If the entire spa is returned to the dealer for repair, all costs of removing and re-installing the spa at Owner’s location will be the responsibility of the Owner. To the maximum extent permitted by
applicable law, repair or replacement, as described above, shall be Bullfrog’s sole liability and your sole and exclusive remedy for any breach of this Limited Warranty.

EXCLUSIONS

This Bullfrog Spa Limited Warranty is void in the following circumstances:
 The spa has been subject to alteration, neglect, misuse or abuse, or to alterations that cause the damage.
 Damage is caused by repair or maintenance work that has been attempted or done by anyone other than an authorized agent of Bullfrog.
 The spa has been used in a non-residential or commercial location (including where a spa may be used by multiple residents of an apartment or townhome complex) or in any way for which it was not designed.
 Damage is caused by an act of God (fire, earthquake, natural disaster or any other external cause), animal, or by any action or omission attributable to you.
 Damage is caused by the addition or use of any non-approved mechanical or electrical component, or chemical substance.
 Damage is caused by shipping, moving, mishandling, improper installation or electrical hookup by someone other than an authorized agent of Bullfrog.
 Damage to the spa shell is caused by excessive heat build- up due to failure to properly cover the spa when it is empty of water or exposed to direct sunlight or other weather conditions.
 Damage is caused by operating the spa outside the water temperature range of 40°F-110°F (4°C-43°C).
 Damage is caused by improper maintenance of spa water chemistry or by allowing undissolved spa chemicals to lie on the spa’s surface.
 Damage is caused by failure to install, maintain and operate the spa in accordance with the recommendations contained in the Bullfrog Owner’s Manual, Pre-Delivery Guide or any other printed instructions, notice or bulletin from Bullfrog.
Any person or company may perform necessary maintenance or repairs on a Bullfrog spa. However, any damages caused by you or anyone other than Bullfrog or its authorized agents are not covered and may void this Limited Warranty.

LIMITATIONS

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS LIMITED WARRANTY STATES BULLFROG’S SOLE LIABILITY AND OBLIGATION FOR ANY SPA PROBLEMS OR MALFUNCTIONS AND FOR ANY WARRANTY BREACHES AND THIS LIMITED WARRANTY TAKES THE PLACE OF ALL OTHER WARRANTIES, CONDITIONS AND OTHER TERMS NOT SET OUT IN THIS LIMITED WARRANTY, WHICH ARE EXPRESSLY EXCLUDED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTIES (SUCH AS IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) ARE LIMITED TO THE STATUTORY PERIOD OR THE DURATION OF THE APPLICABLE WARRANTY STATED ABOVE, WHICHEVER IS SHORTER. NO AGENT, DEALER, DISTRIBUTOR,
SERVICE COMPANY OR OTHER PARTY IS AUTHORIZED TO CHANGE, MODIFY OR EXTEND THE TERMS OF THIS LIMITED WARRANTY IN ANY MANNER WHATSOEVER. THIS LIMITED WARRANTY TERMINATES UPON TRANSFER OF SPA OWNERSHIP.

DISCLAIMERS

NOTHING IN THIS LIMITED WARRANTY EXCLUDES BULLFROG’S LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY BULLFROG’S NEGLIGENCE, FRAUD OR FRAUDULENT MISREPRESENTATION, AND ANY OTHER LIABILITY WHICH CANNOT BE EXCLUDED BY LAW.
EXCEPT AS SET FORTH IN THIS LIMITED WARRANTY OR OTHERWISE REQUIRED BY APPLICABLE LAW,BULLFROG AND ITS AUTHORIZED AGENTS SHALL NOT BE LIABLE FOR: (A) ANY PERSONAL INJURY, DEATH, OR DAMAGES TO PROPERTY; OR (B) ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE, LOSSES OR COSTS, ARISING OUT OF THE SPAS, BULLFROG’S OR ITS AGENTS’ PRODUCTS
OR SERVICES, OR ANY DEFECT COVERED BY THIS LIMITED WARRANTY, INCLUDING WITHOUT LIMITATION, LOSS OF USE OF THE SPA AND COST FOR REMOVAL OF DEFECTIVE PRODUCTS, EVEN IF BULLFROG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
EXCEPT AS REQUIRED BY LAW, THE TOTAL LIABILITY OF BULLFROG AND ITS AUTHORIZED AGENTS TO YOU OR THIRD PARTIES ARISING OUT OF OR IN CONNECTION WITH THIS LIMITED WARRANTY, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY OR OTHERWISE SHALL NOT EXCEED THE ORIGINAL AMOUNT PAID BY YOU FOR THE DEFECTIVE
PRODUCT. COVERAGE UNDER THIS LIMITED WARRANTY SHALL COMMENCE ON THE ORIGINAL DATE OF PURCHASE AND WILL NOT EXTEND FOR ANY REASON WHATSOEVER BEYOND THE STATED TIME PERIOD(S).

LEGAL RIGHTS CONSUMERS

The following applies only if you qualify as a consumer. This Limited Warranty gives you specific legal rights in addition to your statutory rights under applicable consumer protection laws. These statutory rights may vary depending on the laws of your country of residence and are not affected by this warranty.
Some jurisdictions do not allow limitations on, or exclusions of, certain implied terms and conditions, or liabilities. In those cases, this Limited Warranty does not affect, limit or exclude any statutory rights you may have. Prompt return of a completed warranty registration form will help protect your warranty rights. Registration requirements do not apply to residents of jurisdictions where prohibited by law.

GENERAL

Rights of Third Parties

A person who is not party to this Limited Warranty may not enforce any term of this Limited Warranty under the Contracts (Rights of Third Parties) Act 1999.

Invalidity

If a competent court or administrative body finds that any provision of this Limited Warranty is invalid illegal or unenforceable, it will be excluded from the warranty and the rest of this Limited Warranty shall remain unaffected and in force.

Assignment

You may not assign, transfer, mortgage, charge, subcontract, delegate, declare a trust over or deal in any other manner with any of your rights and obligations under this Limited Warranty. 

GOVERNING LAW AND JURISDICTION

This Limited Warranty, and any non-contractual obligations arising from or connected with this Limited Warranty, is governed by and construed under Dutch law, without prejudice to any rights you may have under applicable mandatory laws. You and Bullfrog irrevocably agree that the court of Amsterdam have exclusive jurisdiction to settle any dispute (whether contractual or non-contractual) arising out of or in connection with this Limited Warranty, including as to its existence, validity or termination, unless mandatory applicable laws grant you the right to opt for dispute resolution by a court that would otherwise have jurisdiction under the applicable law.

7-ROČNÁ ZÁRUKA

POVRCH PLÁŠŤA

Spoločnosť Bullfrog zaručuje, že povrchová úprava kúpeľov Bullfrog nebude praskať, nekrčiť sa, pľuzgiere, odlupovať sa ani delaminovať po dobu siedmich rokov od pôvodného dátumu nákupu kúpeľov.

5-ROČNÁ ZÁRUKA

ZARIADENIE

Táto záruka sa osobitne vzťahuje na čerpadlo (čerpadlá), ohrievač, riadiaci systém, zacvakávacie uzávery™, uzáver™ filtra, iné mechanické vybavenie Bullfrog (okrem akéhokoľvek vybavenia uvedeného v iných častiach) a netesnosti z akéhokoľvek komponentu alebo vodovodnej armatúry umiestnenej pod plášťom vírivky.

Na elektrické a mechanické zariadenia s príslušným potrubím a armatúrami sa vzťahuje záruka na chyby materiálu a spracovania päť rokov od dátumu nákupu.

Chybné komponenty, ktoré sa dajú ľahko vybrať z vírivky a ktoré môže zákazník ľahko vymeniť a nevyžadujú špecializované nástroje alebo znalosti alebo nespôsobujú problémy s osobnou bezpečnosťou, z ktorých všetky sa označujú ako „ľahko odstrániteľné komponenty“, budú bezplatne opravené alebo vymenené u vášho autorizovaného predajcu alebo maloobchodnej predajne Bullfrog Spas alebo zaslaním chybných komponentov spoločnosti Bullfrog. Táto záruka sa nevzťahuje na audio systémy, systémy starostlivosti o vodu a vnútorné a vonkajšie systémy osvetlenia vírivky.

SPA SKRINKA a PODSTAVEC

Táto záruka sa konkrétne vzťahuje na rohy skrinky, dvere a bočné panely a lisovanú základňu vírivky.

Na časti skrinky (rohy, dvere, bočné panely) sa vzťahuje záruka na degradáciu materiálu a praskanie po dobu piatich rokov od dátumu nákupu.

TERAPEUTICKÝ SYSTÉM® JETPAK
Táto záruka sa konkrétne vzťahuje na trysky, akékoľvek netesnosti z prúdových armatúr JetPak a systém rozdeľovača JetPak.
Na systém rozdeľovača JetPak sa vzťahuje záruka päť rokov od dátumu nákupu.

Dostupnosť farieb na náhradných a náhradných dieloch JetPaks sa môže líšiť a bude závisieť od dopytu na trhu a dostupnosti farby pre Bullfrog.

3-ROČNÁ ZÁRUKA

KRYT NA TERASU PERFORMANCE™ SPA
Spoločnosť Bullfrog poskytuje záruku na kryt vírivky Patio Performance na chyby materiálu alebo spracovania, pokiaľ sa nezistí, že ide o normálne vyblednutie alebo opotrebovanie, po dobu troch rokov od pôvodného dátumu nákupu vírivky.

ZÁRUKA 1 ROK

OSVETĽOVACIE SYSTÉMY
Spoločnosť Bullfrog poskytuje záruku na vnútorné a vonkajšie systémy osvetlenia vírivky na chyby materiálu a spracovania po dobu jedného roka od pôvodného dátumu nákupu vírivky. Komponenty osvetlenia, ktoré sú ľahko odstrániteľnými komponentmi, ako sú vonkajšie nástenné svetlá, budú bezplatne opravené alebo vymenené u vášho autorizovaného predajcu alebo predajne Bullfrog Spa alebo zaslaním chybných komponentov spoločnosti Bullfrog.
AUDIO SYSTÉMY
Spoločnosť Bullfrog poskytuje záruku na zvukové systémy na chyby materiálu a spracovania po dobu jedného roka od pôvodného dátumu nákupu vírivky.
SYSTÉMY STAROSTLIVOSTI O VODU
Bullfrog poskytuje záruku na systémy starostlivosti o vodu proti chybám materiálu a spracovania po dobu jedného roka od pôvodného dátumu nákupu kúpeľov.

ĎALŠIE ZÁRUKY

Spoločnosť Bullfrog poskytuje záruku na vankúše, kovové trysky a filtre Bullfrog Spa proti chybám materiálu a spracovania počas dodania.

VÝKON A PODMIENKY ZÁRUKY

Spoločnosť Bullfrog alebo jej autorizovaný zástupca (tj personál spoločnosti Bullfrog, jej maloobchodní predajcovia alebo jej autorizované servisné spoločnosti tretích strán) opraví alebo vymení akýkoľvek nefunkčný alebo chybný komponent na vírivke, na ktorý sa vzťahujú podmienky tejto obmedzenej záruky a ktorý bol zakúpený od autorizovaného predajcu alebo maloobchodnej predajne Bullfrog Spas. Spoločnosť Bullfrog si vyhradzuje právo podľa vlastného uváženia opraviť alebo vymeniť chybnú vírivku alebo komponent. Majiteľ je povinný udržiavať voľný prístup k opravám kúpeľov a je zodpovedný za akékoľvek neštandardné náklady na prístup k kúpeľnému vybaveniu alebo kúpeľnej inštalácii. Ak záručný servis vyžaduje odstránenie vírivky, vlastník bude zodpovedný za akékoľvek neštandardné náklady na odstránenie a výmenu vírivky, ako sú kúpele umiestnené v trezore, vírivky umiestnené na hornej palube, kde je potrebný žeriav, alebo oprava alebo výmena palubovky alebo okolitého kameňa alebo betónu.
Ak spoločnosť Bullfrog poskytne náhradnú vírivku alebo komponent, vlastník bude zodpovedný za všetky náklady na odstránenie a výmenu chybného produktu, poplatky za najazdené kilometre, náklady na dopravu náhradného produktu a doručenie. V prípade zlyhania konštrukcie alebo rámu po siedmich rokoch od pôvodného dátumu kúpy vírivky musia byť chybné vírivky zaslané spoločnosti Bullfrog na opravu na náklady majiteľa. V niektorých situáciách môže servisný predajca alebo Bullfrog účtovať majiteľovi primeraný servisný poplatok.
Bullfrog si vyhradzuje právo použiť nové alebo repasované náhradné komponenty. Na akúkoľvek opravu alebo výmenu komponentov alebo vírivky sa nevzťahuje nová alebo predĺžená záruka, ale vzťahuje sa na ňu iba zvyšná časť záručnej doby pôvodného produktu.
Doživotné záruky Bullfrog trvajú po dobu životnosti pôvodného maloobchodného kupujúceho kúpeľov. Ak je pôvodným retailovým kupujúcim spoločnosť alebo subjekt, a nie fyzická osoba (napr. korporácia, spoločnosť s ručením obmedzeným, rodinný trust atď.), „životnosť pôvodného retailového kupujúceho“ znamená desať rokov.
Ak chcete získať záručný servis, kontaktujte autorizovaného predajcu Bullfrog Spas alebo Bullfrog a predložte doklad o kúpe. Od požiadavky na doklad o kúpe sa môže upustiť, ak záznamy spoločnosti Bullfrog alebo predajcu môžu potvrdiť pôvodný dátum nákupu kúpeľov a to, že ste pôvodným kupujúcim. Akákoľvek chybná vírivka alebo komponent zaslaný priamo do továrne na záručnú opravu musí byť vopred autorizovaný spoločnosťou Bullfrog a musí byť vopred zaplatený. Spiatočnú dopravu zaplatí spoločnosť Bullfrog za všetky komponenty a vírivky, na ktoré sa vzťahuje záruka, s výnimkou toho, že vlastník je zodpovedný za všetky poplatky za dopravu za všetky vírivky vrátené na opravu viac ako sedem rokov po dátume nákupu. Keď je celá vírivka odoslaná do továrne na opravu, všetky náklady na odstránenie a opätovnú inštaláciu vírivky v prevádzke vlastníka budú zodpovedné za vlastníka. Oprava alebo výmena, ako je opísané vyššie, je výhradnou zodpovednosťou spoločnosti Bullfrog za akékoľvek porušenie tejto obmedzenej záruky.

VYLÚČENIA

Táto obmedzená záruka Bullfrog Spa je neplatná za nasledujúcich okolností:
▪ Vírivka bola predmetom zanedbávania, nesprávneho používania alebo zneužívania alebo úprav, ktoré spôsobujú škody.
▪ Poškodenie je spôsobené opravou alebo údržbou, o ktorú sa pokúsil alebo ktorú vykonal ktokoľvek iný ako autorizovaný zástupca spoločnosti Bullfrog.
▪ Kúpele boli použité v nebytovom alebo komerčnom prostredí (vrátane miest, kde kúpele môžu využívať viacerí obyvatelia bytového alebo mestského komplexu) alebo akýmkoľvek spôsobom, na ktorý neboli navrhnuté.
▪ Škoda je spôsobená Božím činom (požiar, zemetrasenie, krupobitie atď.) alebo akoukoľvek inou príčinou, ktorú Bullfrog nemôže ovplyvniť.
▪ Poškodenie je spôsobené pridaním alebo použitím akéhokoľvek neschváleného mechanického alebo elektrického komponentu alebo chemickej látky.
▪ Poškodenie je spôsobené prepravou, sťahovaním, nesprávnou manipuláciou, nesprávnou inštaláciou alebo elektrickým pripojením niekým iným ako autorizovaným zástupcom spoločnosti Bullfrog.
▪ Poškodenie plášťa vírivky je spôsobené nadmerným nahromadením tepla v dôsledku nesprávneho zakrytia vírivky, keď je prázdna voda alebo vystavená priamemu slnečnému žiareniu alebo iným poveternostným podmienkam.
▪ Poškodenie je spôsobené prevádzkou vírivky mimo rozsahu teploty vody 40 °F – 110 °F (4 °C – 43 °C).
▪ Poškodenie je spôsobené nesprávnou údržbou chémie kúpeľnej vody alebo tým, že nerozpustené kúpeľné chemikálie ležia na povrchu vírivky.
▪ Poškodenie je spôsobené neinštaláciou, údržbou a prevádzkou vírivky v súlade s odporúčaniami obsiahnutými v návode na obsluhu Bullfrog, príručke pred dodaním alebo v akýchkoľvek iných tlačených pokynoch, oznámení alebo bulletine od spoločnosti Bullfrog.
▪ Poškodenie je spôsobené neposkytnutím správneho základu vírivky, ako je popísané v príručke pred dodaním. Akákoľvek osoba alebo spoločnosť môže vykonávať potrebnú údržbu alebo opravy kúpeľov Bullfrog. Na akékoľvek škody spôsobené vami alebo kýmkoľvek iným ako spoločnosťou Bullfrog alebo jej autorizovanými zástupcami sa však nevzťahuje a môže viesť k strate platnosti tejto obmedzenej záruky.

OBMEDZENIA

TÁTO OBMEDZENÁ ZÁRUKA UVÁDZA VÝHRADNÚ ZODPOVEDNOSŤ A POVINNOSŤ SPOLOČNOSTI BULLFROG ZA AKÉKOĽVEK PROBLÉMY ALEBO PORUCHY SPA A ZA AKÉKOĽVEK PORUŠENIE ZÁRUKY. TÁTO OBMEDZENÁ ZÁRUKA NAHRÁDZA VŠETKY OSTATNÉ ZÁRUKY VRÁTANE AKÝCHKOĽVEK VÝSLOVNÝCH ALEBO ZÁKONNÝCH ZÁRUK. AKÉKOĽVEK IMPLICITNÉ ZÁRUKY (AKO SÚ IMPLICITNÉ ZÁRUKY PREDAJNOSTI A VHODNOSTI NA KONKRÉTNY ÚČEL) SÚ OBMEDZENÉ NA ZÁKONNÉ OBDOBIE ALEBO TRVANIE PRÍSLUŠNEJ ZÁRUKY UVEDENÉ VYŠŠIE, PODĽA TOHO, ČO JE KRATŠIE. ŽIADNY ZÁSTUPCA, PREDAJCA, DISTRIBÚTOR, SERVISNÁ SPOLOČNOSŤ ANI INÁ STRANA NIE JE OPRÁVNENÁ AKÝMKOĽVEK SPÔSOBOM MENIŤ, UPRAVOVAŤ ALEBO PREDLŽOVAŤ PODMIENKY TEJTO OBMEDZENEJ ZÁRUKY. TÁTO OBMEDZENÁ ZÁRUKA KONČÍ PREVODOM VLASTNÍCTVA VÍRIVKY. SPOLOČNOSŤ BULLFROG MÔŽE PODĽA VLASTNÉHO UVÁŽENIA OPRAVIŤ ALEBO VYMENIŤ CHYBNÝ VÝROBOK (KÚPELE ALEBO KOMPONENT). AK JE POTREBNÉ VÍRIVKU VYMENIŤ, ALE AKTUÁLNA TRHOVÁ CENA NÁHRADNÝCH KÚPEĽOV JE VYŠŠIA AKO TRHOVÁ CENA PÔVODNÝCH KÚPEĽOV, MAJITEĽ BUDE MUSIEŤ BUĎ ZAPLATIŤ POPLATOK ZA UPGRADE, ALEBO SI VYBRAŤ NÁHRADNÉ VÍRIVKY POROVNATEĽNÉ S TRHOVOU CENOU PÔVODNÝCH KÚPEĽOV V ČASE ICH KÚPY. PÔVODNÁ ZÁRUČNÁ DOBA SA BUDE NAĎALEJ VZŤAHOVAŤ NA VŠETKY OPRAVENÉ A VYMENENÉ VÍRIVKY A KOMPONENTY A NEBUDE SA ZO ŽIADNEHO DÔVODU OBNOVOVAŤ ANI PREDLŽOVAŤ.

VYLÚČENIE ZODPOVEDNOSTI

Spoločnosť Bullfrog zaručuje, že povrchová úprava kúpeľov Bullfrog nebude praskať, nekrčiť sa, pľuzgiere, odlupovať sa ani delaminovať po dobu siedmich rokov od pôvodného dátumu nákupu kúpeľov.

5-ROČNÁ ZÁRUKA

ZARIADENIE
Táto záruka sa konkrétne vzťahuje na čerpadlo (čerpadlá), ohrievač, riadiaci systém, zacvakávacie uzávery™, iné mechanické vybavenie Bullfrog (okrem akéhokoľvek vybavenia uvedeného v iných častiach) a netesnosti z akéhokoľvek komponentu alebo vodovodnej armatúry umiestnenej pod plášťom vírivky.
Na elektrické a mechanické zariadenia s príslušným potrubím a armatúrami sa vzťahuje záruka na chyby materiálu a spracovania päť rokov od dátumu nákupu.
Chybné komponenty, ktoré sa dajú ľahko vybrať z vírivky a ktoré môže zákazník ľahko vymeniť a nevyžadujú špeciálne nástroje alebo znalosti alebo nespôsobujú problémy s osobnou bezpečnosťou,
všetky z nich sú označované ako „ľahko odstrániteľné komponenty“, budú bezplatne opravené alebo vymenené u vášho autorizovaného predajcu alebo maloobchodnej predajne Bullfrog Spas alebo zaslaním chybných komponentov spoločnosti Bullfrog. Táto záruka sa nevzťahuje na audio systémy, systémy starostlivosti o vodu a vnútorné a vonkajšie systémy osvetlenia vírivky.
SPA SKRINKA
Táto záruka sa konkrétne vzťahuje na rohy skriniek, dvere a bočné panely.

TERAPEUTICKÝ SYSTÉM® JETPAK
Táto záruka sa konkrétne vzťahuje na trysky, akékoľvek netesnosti z prúdových armatúr JetPak a systém rozdeľovača JetPak.
Na systém rozdeľovača JetPak sa vzťahuje záruka päť rokov od dátumu nákupu.
Dostupnosť farieb na náhradných a náhradných dieloch JetPaks sa môže líšiť a bude závisieť od dopytu na trhu a dostupnosti farby pre Bullfrog.

3-ROČNÁ ZÁRUKA

KRYT NA TERASU PERFORMANCE™ SPA

Spoločnosť Bullfrog poskytuje záruku na vnútorné a vonkajšie systémy osvetlenia vírivky na chyby materiálu a spracovania po dobu jedného roka od pôvodného dátumu nákupu vírivky. Komponenty osvetlenia, ktoré sú ľahko odstrániteľnými komponentmi, ako sú vonkajšie nástenné svetlá, budú bezplatne opravené alebo vymenené u vášho autorizovaného predajcu alebo predajne Bullfrog Spa alebo zaslaním chybných komponentov spoločnosti Bullfrog.
AUDIO SYSTÉMY
Spoločnosť Bullfrog poskytuje záruku na zvukové systémy na chyby materiálu a spracovania po dobu jedného roka od pôvodného dátumu nákupu vírivky.
SYSTÉMY STAROSTLIVOSTI O VODU
Bullfrog poskytuje záruku na systémy starostlivosti o vodu proti chybám materiálu a spracovania po dobu jedného roka od pôvodného dátumu nákupu kúpeľov.

ĎALŠIE ZÁRUKY

Spoločnosť Bullfrog poskytuje záruku na vankúše, kovové tryskové plochy, kotvy príslušenstva, skimmery, sedadlá a podlahové krytiny a filtre proti chybám materiálu a spracovania počas dodania.

VÝKON A PODMIENKY ZÁRUKY

Spoločnosť Bullfrog alebo jej autorizovaný zástupca (tj personál spoločnosti Bullfrog, jej maloobchodní predajcovia alebo jej autorizované servisné spoločnosti tretích strán) opraví alebo vymení akýkoľvek nefunkčný alebo chybný komponent na vírivke, na ktorý sa vzťahujú podmienky tejto obmedzenej záruky a ktorý bol zakúpený od autorizovaného predajcu alebo maloobchodnej predajne Bullfrog Spas. Spoločnosť Bullfrog si vyhradzuje právo podľa vlastného uváženia opraviť alebo vymeniť chybnú vírivku alebo komponent. Majiteľ je povinný udržiavať voľný prístup k opravám kúpeľov a je zodpovedný za akékoľvek neštandardné náklady na prístup k kúpeľnému vybaveniu alebo kúpeľnej inštalácii.
Ak spoločnosť Bullfrog poskytne náhradnú vírivku alebo komponent, vlastník bude zodpovedný za všetky náklady na odstránenie a výmenu chybného produktu, poplatky za najazdené kilometre, náklady na dopravu náhradného produktu a doručenie. V prípade zlyhania konštrukcie alebo rámu po siedmich rokoch od pôvodného dátumu kúpy vírivky musia byť chybné vírivky zaslané spoločnosti Bullfrog na opravu na náklady majiteľa. V niektorých situáciách môže servisný predajca alebo Bullfrog účtovať majiteľovi primeraný servisný poplatok.
Keďže vírivky Swim Series sú veľké a často vyžadujú zložité a/alebo drahé spôsoby inštalácie a prispôsobenia, vynaloží sa všetko primerané úsilie na opravu alebo výmenu komponentov na mieste, kde je vírivka nainštalovaná. Ak spoločnosť Bullfrog alebo jej autorizovaný zástupca zistí, že oprava chyby na mieste alebo výmena komponentov nie je možná z dôvodu obmedzení vytvorených miestom inštalácie vírivky, vyhradzujeme si právo požadovať odstránenie vírivky z miesta inštalácie, aby sa zabezpečil bezpečný prístup technika. V takom prípade budú náklady na premiestnenie vírivky na funkčné miesto a opätovnú inštaláciu vírivky po opravách výhradnou zodpovednosťou vlastníka, vrátane akýchkoľvek neštandardných nákladov na odstránenie a výmenu kúpeľov, ako sú kúpele umiestnené v trezore, vírivky umiestnené na hornom poschodí, kde je potrebný žeriav, alebo oprava alebo výmena palubovky alebo okolitého kameňa alebo betónu. V zriedkavých prípadoch, keď je na adekvátne vyriešenie chyby alebo poruchy potrebná náhradná vírivka, bude vlastník výlučne zodpovedný za náklady na odstránenie, náklady na dopravu náhradného produktu a náklady na doručenie na miesto inštalácie.
Bullfrog si vyhradzuje právo použiť nové alebo repasované náhradné komponenty. Na akúkoľvek opravu alebo výmenu komponentov alebo vírivky sa nevzťahuje nová alebo predĺžená záruka, ale vzťahuje sa na ňu iba zvyšná časť záručnej doby pôvodného produktu.
Doživotné záruky Bullfrog trvajú po dobu životnosti pôvodného maloobchodného kupujúceho kúpeľov. Ak je pôvodným maloobchodným kupujúcim spoločnosť alebo subjekt, a nie fyzická osoba (napr. korporácia, spoločnosť s ručením obmedzeným, rodinný trust atď.), „životnosť pôvodného maloobchodného kupujúceho“ znamená desať rokov.
Ak chcete získať záručný servis, kontaktujte autorizovaného predajcu Bullfrog Spas alebo Bullfrog a predložte doklad o kúpe. Od požiadavky na doklad o kúpe sa môže upustiť, ak záznamy spoločnosti Bullfrog alebo predajcu môžu potvrdiť pôvodný dátum nákupu kúpeľov a to, že ste pôvodným kupujúcim. Akákoľvek chybná vírivka alebo komponent zaslaný priamo do továrne na záručnú opravu musí byť vopred autorizovaný spoločnosťou Bullfrog a musí byť vopred zaplatený. Spiatočnú dopravu zaplatí spoločnosť Bullfrog za všetky komponenty a vírivky, na ktoré sa vzťahuje záruka, s výnimkou toho, že vlastník je zodpovedný za všetky poplatky za dopravu za všetky vírivky vrátené na opravu viac ako sedem rokov po dátume nákupu. VYLÚČENIA

▪ Kúpele sa používali v nebytových alebo komerčných lokalitách (vrátane kúpeľov
môže byť používaný viacerými obyvateľmi bytového alebo mestského komplexu) alebo akýmkoľvek spôsobom, na ktorý nebol určený.
▪ Škoda je spôsobená Božím činom (požiar, zemetrasenie, krupobitie atď.) alebo akoukoľvek inou príčinou, ktorú Bullfrog nemôže ovplyvniť.
▪ Poškodenie je spôsobené pridaním alebo použitím akéhokoľvek neschváleného mechanického alebo elektrického komponentu alebo chemickej látky.
▪ Kúpele boli presunuté z pôvodného miesta inštalácie.
▪ Poškodenie je spôsobené prepravou, sťahovaním, nesprávnou manipuláciou, nesprávnou inštaláciou alebo elektrickým pripojením niekým iným ako autorizovaným zástupcom spoločnosti Bullfrog.
▪ Poškodenie plášťa vírivky je spôsobené nadmerným nahromadením tepla v dôsledku nesprávneho zakrytia vírivky, keď je prázdna voda alebo vystavená priamemu slnečnému žiareniu alebo iným poveternostným podmienkam.
▪ Poškodenie je spôsobené prevádzkou vírivky mimo rozsahu teploty vody 40 °F-110 °F (4 °C-43 °C).
▪ Poškodenie je spôsobené nesprávnou údržbou chémie kúpeľnej vody alebo tým, že nerozpustené kúpeľné chemikálie ležia na povrchu vírivky.
▪ Poškodenie je spôsobené neinštaláciou, údržbou a prevádzkou vírivky v súlade s odporúčaniami obsiahnutými v návode na obsluhu Bullfrog, príručke pred dodaním alebo v akýchkoľvek iných tlačených pokynoch, oznámení alebo bulletine od spoločnosti Bullfrog.
▪ Poškodenie je spôsobené neposkytnutím správneho základu vírivky, ako je popísané v príručke pred dodaním.

Akákoľvek osoba alebo spoločnosť môže vykonávať potrebnú údržbu alebo opravy kúpeľov Bullfrog. Na akékoľvek škody spôsobené vami alebo kýmkoľvek iným ako spoločnosťou Bullfrog alebo jej autorizovanými zástupcami sa však nevzťahuje a môže viesť k strate platnosti tejto obmedzenej záruky.

OBMEDZENIA

TÁTO OBMEDZENÁ ZÁRUKA UVÁDZA VÝHRADNÚ ZODPOVEDNOSŤ A POVINNOSŤ SPOLOČNOSTI BULLFROG ZA AKÉKOĽVEK PROBLÉMY ALEBO PORUCHY SPA A ZA AKÉKOĽVEK PORUŠENIE ZÁRUKY. TÁTO OBMEDZENÁ ZÁRUKA NAHRÁDZA VŠETKY OSTATNÉ ZÁRUKY VRÁTANE AKÝCHKOĽVEK VÝSLOVNÝCH ALEBO ZÁKONNÝCH ZÁRUK. AKÉKOĽVEK IMPLICITNÉ ZÁRUKY (AKO SÚ IMPLICITNÉ ZÁRUKY PREDAJNOSTI A VHODNOSTI NA KONKRÉTNY ÚČEL) SÚ OBMEDZENÉ NA ZÁKONNÉ OBDOBIE ALEBO TRVANIE PRÍSLUŠNEJ ZÁRUKY UVEDENÉ VYŠŠIE, PODĽA TOHO, ČO JE KRATŠIE. ŽIADNY ZÁSTUPCA, PREDAJCA, DISTRIBÚTOR, SERVISNÁ SPOLOČNOSŤ ANI INÁ STRANA NIE JE OPRÁVNENÁ AKÝMKOĽVEK SPÔSOBOM MENIŤ, UPRAVOVAŤ ALEBO PREDLŽOVAŤ PODMIENKY TEJTO OBMEDZENEJ ZÁRUKY. TÁTO OBMEDZENÁ ZÁRUKA KONČÍ PREVODOM VLASTNÍCTVA VÍRIVKY. SPOLOČNOSŤ BULLFROG MÔŽE PODĽA VLASTNÉHO UVÁŽENIA OPRAVIŤ ALEBO VYMENIŤ CHYBNÝ VÝROBOK (KÚPELE ALEBO KOMPONENT). AK JE POTREBNÉ VÍRIVKU VYMENIŤ, ALE AKTUÁLNA TRHOVÁ CENA NÁHRADNÝCH VÍRIVIEK JE VYŠŠIA AKO PÔVODNÁ CENA MSTKRY V KÚPEĽOCH, MAJITEĽ BUDE MUSIEŤ BUĎ ZAPLATIŤ POPLATOK ZA UPGRADE, ALEBO SI VYBRAŤ NÁHRADNÉ VÍRIVKY POROVNATEĽNÉ S TRHOVOU CENOU PÔVODNÝCH VÍRIVIEK V ČASE ICH KÚPY. PÔVODNÁ ZÁRUČNÁ DOBA SA BUDE NAĎALEJ VZŤAHOVAŤ NA VŠETKY OPRAVENÉ A VYMENENÉ VÍRIVKY A KOMPONENTY A NEBUDE SA ZO ŽIADNEHO DÔVODU OBNOVOVAŤ ANI PREDLŽOVAŤ.
OKREM PRÍPADOV UVEDENÝCH V TEJTO OBMEDZENEJ ZÁRUKE ALEBO INAK VYŽADOVANÝCH PLATNÝMI ZÁKONMI, SPOLOČNOSŤ BULLFROG A JEJ OPRÁVNENÍ ZÁSTUPCOVIA NENESÚ ZODPOVEDNOSŤ ZA ŽIADNE ZRANENIE OSÔB, SMRŤ, ŠKODY NA MAJETKU, STRATY, NÁKLADY ALEBO INÉ ŠKODY, ČI UŽ PRIAME, NÁHODNÉ, NÁSLEDNÉ, ŠPECIÁLNE ALEBO REPRESÍVNE, VYPLÝVAJÚCE ZO SLUŽIEB SPA, SPOLOČNOSTI BULLFROG ALEBO JEJ ZÁSTUPCOV, ALEBO ZA AKÚKOĽVEK CHYBU, NA KTORÚ SA VZŤAHUJE TÁTO OBMEDZENÁ ZÁRUKA, VRÁTANE, BEZ OBMEDZENIA, STRATY POUŽÍVANIA VÍRIVKY A NÁKLADOV NA ODSTRÁNENIE CHYBNÝCH PRODUKTOV, AJ KEĎ BOL BULLFROG UPOZORNENÝ NA MOŽNOSŤ TAKÉHOTO POŠKODENIA. LIMITED WARRANTY

X Series for United States and Canada
Bullfrog International, LC (“Bullfrog” or “we”) extends the following coverage under this Limited Warranty solely to the original end-user purchaser (“Owner” or “you”) of any 2023 model year and later X Series Bullfrog Spas hot tub manufactured on or after February 1, 2023 and installed
for residential use in the United States or Canada.

5 YEAR WARRANTY

SHELL STRUCTURE
Bullfrog warrants the Bullfrog Spa shell will not leak for five years from the original spa purchase date.
ENDURAFRAME™
Bullfrog warrants the EnduraFrame (injection-molded spa frame) against degradation for five years from the original spa purchase date.

3 YEAR WARRANTY

SHELL SURFACE
Bullfrog warrants the surface finish of the Bullfrog Spa will not crack, craze wrinkle, blister, peel or delaminate for three years from the original spa purchase date.
EQUIPMENT
This warranty specifically covers the pump(s), heater, control system, FilterCap™, other Bullfrog mechanical equipment (excluding any equipment listed in other sections), and leaks from any component or plumbing fitting located beneath the spa shell.
Electrical and mechanical equipment with its associated piping and fittings are warranted against defects in materials and workmanship for three years from purchase date. Defective components that are easily removed from the spa and that can be readily replaced by the customer and do not require specialized tools or knowledge or create personal safety issues, all of which are referred to as “Easily Removed Components,” will be repaired or replaced free of charge at your authorized Bullfrog Spas dealer or retail store or by sending the defective
component(s) to Bullfrog. This warranty excludes audio systems, water care systems, and the interior and exterior spa lighting systems.
SPA CABINET
This warranty specifically covers the cabinet corners, door and side panels.
Cabinet sections (corners, doors, side panels) are warranted against material degradation and cracking for three years from purchase date.
PATIO PERFORMANCE™ SPA COVER
Bullfrog warrants the Patio Performance spa cover against defects in materials or workmanship, unless determined to be normal fading or wear, for three years from the original spa purchase date.

1 YEAR WARRANTY

LIGHTING SYSTEMS
Bullfrog warrants the interior and exterior spa lighting systems against defects in materials and workmanship for one year from the original spa purchase date. Lighting components that are Easily Removed Components, such as exterior sconce lights, will be repaired or replaced free of charge at your authorized Bullfrog Spa dealer or retail store or by sending the defective component(s) to Bullfrog.
AUDIO SYSTEMS
Bullfrog warrants audio systems against defects in materials and workmanship for one year from the original spa purchase date.
WATER CARE SYSTEMS
Bullfrog warrants water care systems against defects in materials and workmanship for one year from the original spa purchase date.

OTHER WARRANTIES

Bullfrog warrants the Bullfrog Spa pillows, metal jet faces, and filters against defects in materials and workmanship through time of delivery.


WARRANTY PERFORMANCE and TERMS

Bullfrog or its authorized agent (i.e., personnel of Bullfrog, its retail dealers, or its authorized third-party service companies) will repair or replace any malfunctioning or defective component on the spa that is covered under the terms of this Limited Warranty and was purchased from an authorized Bullfrog Spas dealer or retail store. Bullfrog reserves the right, at its option, to either
repair or replace a defective spa or component. Owner is required to maintain clear access for spa repairs and is responsible for any non-standard costs of accessing spa equipment or spa plumbing. When warranty service requires removal of the spa, Owner will be responsible for any non-standard costs of spa removal and replacement, such as for spas located in a vault, spas located on an upper deck where a crane is required, or repair or replacement of decking or
surrounding stone or concrete.
If a replacement spa or component is provided by Bullfrog, Owner will be responsible for all costs for removal and replacement of the defective product, mileage charges, shipping costs of the replacement product, and delivery. In the event of a structure or frame failure after seven years from the original spa purchase date, the defective spa must be sent to Bullfrog for repair at
Owner’s expense. In some situations, the servicing dealer or Bullfrog may charge Owner a reasonable service fee.
Bullfrog reserves the right to use either new or reconditioned replacement components. Any repair or replacement component or spa does not receive new or extended warranty coverage but is covered only under the remaining portion of the original product’s warranty term.

To obtain warranty service, contact your authorized Bullfrog Spas dealer or Bullfrog and submit proof of purchase. The proof of purchase requirement may be waived if Bullfrog’s or the dealer’s records can confirm the original spa purchase date and that you are the original purchaser. Any defective spa or component sent directly to the factory for warranty repair must be preauthorized by Bullfrog and must be freight prepaid. Return freight will be paid by Bullfrog on all warranted components and spas, except that Owner is responsible for all shipping charges for any spa returned for repairs more than seven years after its purchase date. When the entire spa is sent to the factory for repair, all costs of removing and re-installing the spa at Owner’s location will be the responsibility of Owner. Repair or replacement, as described above, shall be Bullfrog’s sole liability for any breach of this Limited Warranty.

 

EXCLUSIONS

This Bullfrog Spa Limited Warranty is void in the following circumstances:
▪ The spa has been subject to neglect, misuse or abuse, or to alterations that cause the damage.
▪ Damage is caused by repair or maintenance work that has been attempted or done by anyone other than an authorized agent of Bullfrog.
▪ The spa has been used in a non-residential or commercial location (including where a spa may be used by multiple residents of an apartment or townhome complex) or in any way for which it was not designed.
▪ Damage is caused by an act of God (fire, earthquake, hail, etc.) or any other cause beyond the control of Bullfrog.
▪ Damage is caused by the addition or use of any non-approved mechanical or electrical component, or chemical substance.
▪ Damage is caused by shipping, moving, mishandling, improper installation or electrical hook-up by someone other than an authorized agent of Bullfrog.
▪ Damage to the spa shell is caused by excessive heat build-up due to failure to properly cover the spa when it is empty of water or exposed to direct sunlight or other weather conditions.
▪ Damage is caused by operating the spa outside the water temperature range of 40°F-110°F (4°C-43°C).
▪ Damage is caused by improper maintenance of spa water chemistry or by allowing undissolved spa chemicals to lie on the spa’s surface.
▪ Damage is caused by failure to install, maintain and operate the spa in accordance with the recommendations contained in the Bullfrog Owner’s Manual, Pre-Delivery Guide or any other printed instructions, notice or bulletin from Bullfrog.
▪ Damage is caused by failure to provide a proper spa foundation as described in the Pre-Delivery Guide.
Any person or company may perform necessary maintenance or repairs on a Bullfrog spa. However, any damages caused by you or anyone other than Bullfrog or its authorized agents are not covered and may void this Limited Warranty.


LIMITATIONS

THIS LIMITED WARRANTY STATES BULLFROG’S SOLE LIABILITY AND OBLIGATION FOR ANY SPA PROBLEMS OR MALFUNCTIONS AND FOR ANY WARRANTY BREACHES. THIS LIMITED WARRANTY TAKES THE PLACE OF ALL OTHER WARRANTIES, INCLUDING ANY EXPRESS OR STATUTORY WARRANTIES. ANY IMPLIED WARRANTIES (SUCH AS IMPLIED WARRANTIES OF MERCHANTABILITY
AND FITNESS FOR A PARTICULAR PURPOSE) ARE LIMITED TO THE STATUTORY PERIOD OR THE DURATION OF THE APPLICABLE WARRANTY STATED ABOVE, WHICHEVER IS SHORTER. NO AGENT, DEALER, DISTRIBUTOR, SERVICE COMPANY OR OTHER PARTY IS AUTHORIZED TO CHANGE, MODIFY OR EXTEND THE TERMS OF THIS LIMITED WARRANTY IN ANY MANNER WHATSOEVER. THIS LIMITED WARRANTY TERMINATES UPON TRANSFER OF SPA OWNERSHIP. BULLFROG MAY,
AT ITS OPTION, EITHER REPAIR OR REPLACE A DEFECTIVE PRODUCT (SPA OR A COMPONENT). IF THE SPA NEEDS TO BE REPLACED BUT THE CURRENT MARKET PRICE OF THE REPLACEMENT SPA IS GREATER THAN THE ORIGINAL SPA’S MARKET PRICE, OWNER WILL BE REQUIRED TO EITHER PAY AN UPGRADE FEE OR CHOOSE A REPLACEMENT SPA COMPARABLE TO THE MARKET PRICE OF THE ORIGINAL SPA AT THE TIME OF ITS PURCHASE. THE ORIGINAL WARRANTY PERIOD WILL CONTINUE TO APPLY TO ALL REPAIRED AND REPLACEMENT SPAS AND COMPONENTS AND WILL NOT BE RENEWED OR EXTENDED FOR ANY REASON.
DISCLAIMERS EXCEPT AS SET FORTH IN THIS LIMITED WARRANTY OR OTHERWISE REQUIRED BY APPLICABLE LAW, BULLFROG AND ITS AUTHORIZED AGENTS SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, DEATH, DAMAGES TO PROPERTY, LOSS, COST OR OTHER DAMAGE, WHETHER DIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE, ARISING OUT OF THE SPAS, BULLFROG’S OR ITS AGENTS’ SERVICES, OR ANY DEFECT COVERED BY THIS LIMITED WARRANTY, INCLUDING WITHOUT LIMITATION LOSS OF USE OF THE SPA AND COST FOR REMOVAL OF DEFECTIVE PRODUCTS, EVEN IF BULLFROG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS REQUIRED BY LAW, THE TOTAL LIABILITY OF BULLFROG AND ITS AUTHORIZED AGENTS TO YOU OR THIRD PARTIES SHALL NOT EXCEED THE ORIGINAL AMOUNT PAID FOR THE
DEFECTIVE PRODUCT.

Séria M, séria A a STIL pre Európsku úniu a Spojené kráľovstvo Bullfrog International, LC („Bullfrog“ alebo „my“) rozširuje nasledujúce krytie v rámci tejto obmedzenej záruky výlučne na pôvodného kupujúceho koncového používateľa („vlastník“ alebo „vy“) akejkoľvek kúpele série M, série A alebo STIL vyrobenej 1. januára 2025 alebo neskôr a nainštalovanej na rezidenčné použitie v Európskej únii a Spojenom kráľovstve.


10-ROČNÁ ZÁRUKA

ENDURAFRAME™
Bullfrog poskytuje záruku na EnduraFrame (vstrekovaný rám vírivky) proti degradácii po dobu desiatich rokov od pôvodného dátumu nákupu vírivky.
ŠKRUPINOVÁ ŠTRUKTÚRA
Spoločnosť Bullfrog zaručuje, že škrupina Bullfrog Spa nevytečie desať rokov od pôvodného dátumu nákupu kúpeľov.


7-ROČNÁ ZÁRUKA

POVRCH PLÁŠŤA
Spoločnosť Bullfrog zaručuje, že povrchová úprava kúpeľov Bullfrog nebude praskať, šialeniť, pokrčiť, pokrčiť sa, odlupovať alebo delaminovať po dobu siedmich rokov od pôvodného dátumu nákupu kúpeľov.


5-ROČNÁ ZÁRUKA

ZARIADENIE
Táto záruka sa osobitne vzťahuje na čerpadlo (čerpadlá), ohrievač, riadiaci systém, zacvakávacie uzávery™, uzáver™ filtra, iné mechanické vybavenie Bullfrog (okrem akéhokoľvek vybavenia uvedeného v iných častiach) a netesnosti z akéhokoľvek komponentu alebo vodovodnej armatúry umiestnenej pod plášťom vírivky.
Na elektrické a mechanické zariadenia s príslušným potrubím a armatúrami sa vzťahuje záruka na chyby materiálu a spracovania päť rokov od dátumu nákupu.
Chybné komponenty, ktoré sa dajú ľahko odstrániť z vírivky a ktoré môže zákazník ľahko vymeniť a nevyžadujú špecializované nástroje alebo znalosti alebo nespôsobujú problémy s osobnou bezpečnosťou, ktoré sa označujú ako ľahko odstrániteľné komponenty, budú bezplatne opravené alebo vymenené u vás
autorizovaný predajca Bullfrog Spas. Táto záruka sa nevzťahuje na audio systémy, systémy starostlivosti o vodu a vnútorné a vonkajšie systémy osvetlenia vírivky.
SPA SKRINKA a PODSTAVEC
Táto záruka sa konkrétne vzťahuje na rohy skrinky, dvere a bočné panely a lisovanú základňu vírivky.

Časti skrinky (rohy, dvere, bočné panely) sú chránené proti degradácii a prasknutiu po dobu piatich
rokov od dátumu nákupu.

EnduraBase™ má záruku na degradáciu a praskanie po dobu piatich rokov od dátumu nákupu. Chybné položky budú opravené podľa podmienok tejto záruky.
TERAPEUTICKÝ SYSTÉM® JETPAK
Táto záruka sa konkrétne vzťahuje na trysky, akékoľvek netesnosti z prúdových armatúr JetPak a systém rozdeľovača JetPak.
Na systém rozdeľovača JetPak sa vzťahuje záruka päť rokov od dátumu nákupu.
Dostupnosť farieb na náhradných a náhradných dieloch JetPaks sa môže líšiť a bude závisieť od dopytu na trhu a dostupnosti farby pre Bullfrog.

ZÁRUKA 1 ROK

KRYT NA TERASU PERFORMANCE™ SPA
Bullfrog poskytuje záruku na kryt vírivky Patio Performance na chyby materiálu alebo spracovania,
pokiaľ sa nezistí, že ide o normálne vyblednutie alebo opotrebovanie, po dobu 1 roka od pôvodného dátumu nákupu vírivky.

2-ROČNÁ ZÁRUKA

OSVETĽOVACIE SYSTÉMY
Spoločnosť Bullfrog poskytuje záruku na vnútorné a vonkajšie systémy osvetlenia vírivky na chyby materiálu a spracovania po dobu dvoch rokov od pôvodného dátumu nákupu vírivky. Komponenty osvetlenia, ktoré sú ľahko odstrániteľnými komponentmi, ako sú vonkajšie nástenné svetlá, budú bezplatne opravené alebo vymenené u vášho autorizovaného predajcu Bullfrog Spa.
AUDIO SYSTÉMY
Spoločnosť Bullfrog poskytuje záruku na audio systémy na chyby materiálu a spracovania po dobu dvoch rokov od pôvodného dátumu nákupu vírivky.
SYSTÉMY STAROSTLIVOSTI O VODU
Spoločnosť Bullfrog poskytuje záruku na systémy starostlivosti o vodu proti chybám materiálu a spracovania po dobu dvoch rokov od pôvodného dátumu nákupu vírivky.


ĎALŠIE ZÁRUKY

Spoločnosť Bullfrog poskytuje záruku na vankúše, kovové trysky a filtre Bullfrog Spa proti chybám materiálu a spracovania v čase dodania.

VÝKON A PODMIENKY ZÁRUKY

Spoločnosť Bullfrog alebo jej autorizovaný zástupca (tj personál spoločnosti Bullfrog, jej maloobchodní predajcovia alebo jej autorizované servisné spoločnosti tretích strán) opraví alebo vymení akýkoľvek nefunkčný alebo chybný komponent na vírivke Bullfrog, na ktorý sa vzťahujú podmienky tejto obmedzenej záruky a ktorý bol zakúpený od autorizovaného predajcu alebo maloobchodnej predajne Bullfrog Spas. Spoločnosť Bullfrog si pritom vyhradzuje právo podľa vlastného uváženia opraviť alebo vymeniť chybnú vírivku alebo komponent. Majiteľ je povinný udržiavať voľný prístup do kúpeľného vybavenia a je zodpovedný za prípadné neštandardné náklady na prístup k kúpeľnému vybaveniu. Ak spoločnosť Bullfrog alebo jej autorizovaný zástupca rozhodne, že oprava chyby nie je možná, spoločnosť Bullfrog alebo jej autorizovaný zástupca môže namiesto toho poskytnúť náhradnú vírivku alebo komponent v rovnakej hodnote ako chybná vírivka alebo komponent. V prípadoch, keď je povolená náhradná vírivka, sa spoločnosť Bullfrog pokúsi nahradiť vírivku kúpele s rovnakou trhovou hodnotou. Ak to Bullfrog povolí, môžete si vybrať kúpele s vyššou cenou zaplatením rozdielu medzi trhovou hodnotou vašich pôvodných kúpeľov v čase nákupu a aktuálnou trhovou cenou nových náhradných kúpeľov.
Majiteľ bude zodpovedný za akékoľvek neštandardné náklady na odstránenie a výmenu kúpeľov, ako sú vírivky umiestnené v trezore, vírivky umiestnené na balkóne alebo palube, kde je potrebný žeriav, alebo oprava alebo výmena paluby. Po šiestich mesiacoch od pôvodného dátumu nákupu vírivky bude vlastník zodpovedný za všetky náklady na odstránenie a výmenu chybného produktu, poplatky za najazdené kilometre predajcu, náklady na dopravu náhradného produktu a doručenie. V prípade zlyhania konštrukcie alebo rámu po troch rokoch od pôvodného dátumu nákupu vírivky je potrebné chybnú vírivku zaslať autorizovanému predajcovi Bullfrog Spa na opravu na náklady majiteľa. V niektorých situáciách môže servisný predajca alebo Bullfrog
účtovať majiteľovi primeraný servisný poplatok.
Bullfrog si vyhradzuje právo použiť nové alebo repasované náhradné komponenty. Na akúkoľvek opravu alebo výmenu komponentov alebo vírivky sa nevzťahuje nová alebo predĺžená záruka, ale vzťahuje sa na ňu iba zvyšná časť záručnej doby pôvodného produktu.
Ak chcete získať záručný servis, kontaktujte svojho autorizovaného predajcu Bullfrog Spas a predložte doklad o kúpe. Od požiadavky na doklad o kúpe sa môže upustiť, ak záznamy spoločnosti Bullfrog alebo predajcu môžu potvrdiť pôvodný dátum nákupu kúpeľov a to, že ste pôvodným kupujúcim. Akákoľvek chybná vírivka alebo komponent zaslaný priamo predajcovi na záručnú opravu musí byť vopred autorizovaný predajcom alebo
Bullfrog a musí byť predplatená preprava. Spiatočnú dopravu zaplatí spoločnosť Bullfrog za všetky komponenty a vírivky, na ktoré sa vzťahuje záruka, s výnimkou akýchkoľvek vrátených kúpeľov, ktoré sú viac ako tri roky od dátumu nákupu. Ak sa celá vírivka vráti predajcovi na opravu, všetky náklady na odstránenie a opätovnú inštaláciu vírivky u majiteľa znáša vlastník. V maximálnom rozsahu povolenom platnými zákonmi bude oprava alebo výmena, ako je opísané vyššie, výhradnou zodpovednosťou spoločnosti Bullfrog a vaším jediným a výhradným opravným prostriedkom za akékoľvek porušenie tejto obmedzenej záruky.

VYLÚČENIA

Táto obmedzená záruka Bullfrog Spa je neplatná za nasledujúcich okolností:
 Vírivka bola vystavená zmenám, zanedbávaniu, nesprávnemu používaniu alebo zneužitiu alebo zmenám, ktoré spôsobujú
poškodenie.
 Poškodenie je spôsobené opravou alebo údržbou, o ktorú sa pokúsil alebo ktorú vykonal ktokoľvek iný ako autorizovaný zástupca spoločnosti Bullfrog.
 Kúpele boli využívané v nebytovom alebo komerčnom prostredí (vrátane prípadov, keď kúpele môžu využívať viacerí obyvatelia bytového alebo mestského komplexu) alebo akýmkoľvek spôsobom, na ktorý neboli navrhnuté.
 Škoda je spôsobená vyššou mocou (požiar, zemetrasenie, prírodná katastrofa alebo akákoľvek iná vonkajšia príčina), zvieraťom alebo akýmkoľvek konaním alebo opomenutím, ktoré vám možno pripísať.
 Poškodenie je spôsobené pridaním alebo použitím akéhokoľvek neschváleného mechanického alebo elektrického komponentu alebo chemickej látky.
 Poškodenie je spôsobené prepravou, premiestnením, nesprávnou manipuláciou, nesprávnou inštaláciou alebo elektrickým pripojením niekým iným ako autorizovaným zástupcom spoločnosti Bullfrog.
 Poškodenie plášťa vírivky je spôsobené nadmerným nahromadením tepla v dôsledku nesprávneho zakrytia vírivky, keď je prázdna voda alebo vystavená priamemu slnečnému žiareniu alebo iným poveternostným podmienkam.
 Poškodenie je spôsobené prevádzkou vírivky mimo rozsahu teploty vody 40 °F-110 °F (4 °C-43 °C).
 Poškodenie je spôsobené nesprávnou údržbou chémie vody vo vírivke alebo tým, že nerozpustené chemikálie vo vírivke ležia na povrchu vírivky.
 Poškodenie je spôsobené neinštaláciou, údržbou a prevádzkou vírivky v súlade s odporúčaniami obsiahnutými v návode na obsluhu Bullfrog, Príručke pred dodaním alebo v iných tlačených pokynoch, oznámeniach alebo bulletinoch od spoločnosti Bullfrog.
Akákoľvek osoba alebo spoločnosť môže vykonávať potrebnú údržbu alebo opravy kúpeľov Bullfrog. Na akékoľvek škody spôsobené vami alebo kýmkoľvek iným ako spoločnosťou Bullfrog alebo jej autorizovanými zástupcami sa však nevzťahuje a môže viesť k strate platnosti tejto obmedzenej záruky.

V MAXIMÁLNOM ROZSAHU POVOLENOM PLATNÝMI ZÁKONMI TÁTO OBMEDZENÁ ZÁRUKA UVÁDZA VÝHRADNÚ ZODPOVEDNOSŤ A POVINNOSŤ SPOLOČNOSTI BULLFROG ZA AKÉKOĽVEK PROBLÉMY ALEBO PORUCHY SPA A ZA AKÉKOĽVEK PORUŠENIE ZÁRUKY A TÁTO OBMEDZENÁ ZÁRUKA NAHRÁDZA VŠETKY OSTATNÉ ZÁRUKY, PODMIENKY A INÉ PODMIENKY, KTORÉ NIE SÚ UVEDENÉ V TEJTO OBMEDZENEJ ZÁRUKE, KTORÉ
SÚ VÝSLOVNE VYLÚČENÉ. V MAXIMÁLNOM ROZSAHU POVOLENOM PLATNÝMI ZÁKONMI SÚ AKÉKOĽVEK IMPLICITNÉ ZÁRUKY (AKO SÚ IMPLICITNÉ ZÁRUKY PREDAJNOSTI A VHODNOSTI NA KONKRÉTNY ÚČEL) OBMEDZENÉ NA ZÁKONNÉ OBDOBIE ALEBO TRVANIE PRÍSLUŠNEJ ZÁRUKY UVEDENÉ VYŠŠIE, PODĽA TOHO, ČO JE KRATŠIE. ŽIADNY ZÁSTUPCA, PREDAJCA, DISTRIBÚTOR,
SERVISNÁ SPOLOČNOSŤ ALEBO INÁ STRANA JE OPRÁVNENÁ AKÝMKOĽVEK SPÔSOBOM MENIŤ, UPRAVOVAŤ ALEBO PREDLŽOVAŤ PODMIENKY TEJTO OBMEDZENEJ ZÁRUKY. TÁTO OBMEDZENÁ ZÁRUKA KONČÍ PREVODOM VLASTNÍCTVA VÍRIVKY.

OKREM PRÍPADOV UVEDENÝCH V TEJTO OBMEDZENEJ ZÁRUKE ALEBO INAK VYŽADOVANÝCH PRÍSLUŠNÝMI ZÁKONMI SPOLOČNOSŤ BULLFROG A JEJ AUTORIZOVANÍ ZÁSTUPCOVIA NENESÚ ZODPOVEDNOSŤ ZA: (A) AKÉKOĽVEK ZRANENIE OSÔB,

BULLFROG BOL UPOZORNENÝ NA MOŽNOSŤ TAKÉHOTO POŠKODENIA. OKREM PRÍPADOV VYŽADOVANÝCH ZÁKONOM CELKOVÁ ZODPOVEDNOSŤ SPOLOČNOSTI BULLFROG A JEJ OPRÁVNENÝCH ZÁSTUPCOV VOČI VÁM ALEBO TRETÍM STRANÁM VYPLÝVAJÚCA Z TEJTO OBMEDZENEJ ZÁRUKY ALEBO V SÚVISLOSTI S ŇOU, ČI UŽ VYPLÝVA ZO ZMLUVY, DELIKTU (VRÁTANE NEDBANLIVOSTI), PORUŠENIA ZÁKONNEJ POVINNOSTI ALEBO INAK, NEPRESIAHNE PÔVODNÚ SUMU, KTORÚ STE ZAPLATILI ZA CHYBNÝ PRODUKT. ZÁKONNÉ PRÁVA SPOTREBITEĽOV

Nasledujúce platí len v prípade, že spĺňate podmienky spotrebiteľa. Táto obmedzená záruka vám poskytuje špecifické zákonné práva okrem vašich zákonných práv podľa platných zákonov na ochranu spotrebiteľa. Tieto zákonné práva sa môžu líšiť v závislosti od zákonov krajiny vášho bydliska a nie sú tým ovplyvnené
záruka.
Niektoré jurisdikcie nepovoľujú obmedzenia alebo vylúčenia určitých implicitných podmienok alebo záväzkov. V týchto prípadoch táto obmedzená záruka neovplyvňuje, neobmedzuje ani nevylučuje žiadne zákonné práva, ktoré môžete mať. Rýchle vrátenie vyplneného registračného formulára záruky pomôže chrániť vaše záručné práva. Požiadavky na registráciu sa nevzťahujú na obyvateľov jurisdikcií, kde to zákon zakazuje.

Osoba, ktorá nie je zmluvnou stranou tejto obmedzenej záruky, nesmie vymáhať žiadnu podmienku tejto obmedzenej záruky podľa zákona o zmluvách (práva tretích strán) z roku 1999.


Neplatnosť

Ak príslušný súd alebo správny orgán zistí, že niektoré ustanovenie tejto obmedzenej záruky je neplatné, nezákonné alebo nevymáhateľné, bude vylúčené zo záruky a zvyšku tejto obmedzenej záruky
zostávajú nedotknuté a v platnosti.

Úloha

Nesmiete postúpiť, previesť, zastaviť hypotéku, účtovať, zadávať subdodávateľom, delegovať, deklarovať správu alebo obchodovať s nimi
akýmkoľvek iným spôsobom s akýmikoľvek vašimi právami a povinnosťami vyplývajúcimi z tejto obmedzenej záruky.


ROZHODNÉ PRÁVO A JURISDIKCIA

Vy a Bullfrog neodvolateľne súhlasíte s tým, že súd
Amsterdam má výlučnú právomoc riešiť akýkoľvek spor (či už zmluvný alebo mimozmluvný) vyplývajúci z tejto obmedzenej záruky alebo v súvislosti s ňou, vrátane jej existencie, platnosti alebo ukončenia, pokiaľ vám záväzné platné zákony neudeľujú právo rozhodnúť sa pre riešenie sporov súdom, ktorý by inak mal právomoc podľa platných právnych predpisov.

LIMITED WARRANTY

X Series for European Union & United Kingdom Bullfrog International, LC (“Bullfrog” or “we”) extends the following coverage under this Limited Warranty
solely to the original end-user purchaser (“Owner” or “you”) of any X Series manufactured on or after January 1, 2025 and installed for residential use in European Union and the United Kingdom.

5 YEAR WARRANTY

ENDURAFRAME™
Bullfrog warrants the EnduraFrame (injection-molded spa frame) against degradation for five years from the original spa purchase date.
SHELL STRUCTURE
Bullfrog warrants the Bullfrog Spa shell will not leak for five years from the original spa purchase
date.

3 YEAR WARRANTY

SHELL SURFACE
Bullfrog warrants the surface finish of the Bullfrog Spa will not crack, craze, wrinkle, blister, peel or delaminate for three years from the original spa purchase date.
EQUIPMENT
This warranty specifically covers the pump(s), heater, control system, FilterCap™, other Bullfrog mechanical equipment (excluding any equipment listed in other sections), and leaks from any component or plumbing fitting located beneath the spa shell.
Electrical and mechanical equipment with its associated piping and fittings are warranted against defects in materials and workmanship for three years from purchase date.
Defective components that are easily removed from the spa and that can be readily replaced by the customer and do not require specialized tools or knowledge or create personal safety issues, all of which are referred to as Easily Removed Components, will be repaired or replaced free of charge at your
authorized Bullfrog Spas dealer. This warranty excludes audio systems, water care systems, and interior and exterior spa lighting systems.
SPA CABINET and BASE
This warranty specifically covers the cabinet corners, door and side panels, and the molded spa base.
Cabinet sections (corners, doors, side panels) are warranted against degradation and cracking for three years from purchase date.
EnduraBase™ is warranted against degradation and cracking for three years from purchase date. Defective items will be repaired under the terms of this warranty.

1 YEAR WARRANTY

PATIO PERFORMANCE™ SPA COVER
Bullfrog warrants the Patio Performance spa cover against defects in materials or workmanship, unless determined to be normal fading or wear, for 1 year from the original spa purchase date.

2 YEAR WARRANTY

LIGHTING SYSTEMS
Bullfrog warrants the interior and exterior spa lighting systems against defects in materials and workmanship for two years from the original spa purchase date. Lighting components that are Easily Removed Components, such as the exterior sconce lights, will be repaired or replaced free of charge at your authorized Bullfrog Spa dealer.
AUDIO SYSTEMS
Bullfrog warrants audio systems against defects in materials and workmanship for two years from the original spa purchase date.
WATER CARE SYSTEMS
Bullfrog warrants water care systems against defects in materials and workmanship for two years from the original spa purchase date.

OTHER WARRANTIES

Bullfrog warrants the Bullfrog Spa pillows, metal jet faces, and filters against defects in materials and workmanship at the time of delivery.

WARRANTY PERFORMANCE and TERMS

Bullfrog or its authorized agent (i.e., personnel of Bullfrog, its retail dealers, or its authorized third party service companies) will repair or replace any malfunctioning or defective component on the Bullfrog spa that is covered under the terms of this Limited Warranty and was purchased from an authorized Bullfrog Spas dealer or retail store. In doing so, Bullfrog reserves the right, at its option, to either repair or replace the defective spa or component. Owner is required to maintain clear access to the spa equipment bay and is responsible for any non-standard costs of accessing spa equipment.
If Bullfrog or its authorized agent determines that repairing the defect is not feasible, Bullfrog or its authorized agent may instead provide a replacement spa or component equal in value to the defective spa or component. In cases where a replacement spa is authorized, Bullfrog will attempt to replace the spa with one of equal market value. If authorized by Bullfrog, you may also be allowed to
choose a higher-priced spa by paying the difference between the market value of your original spa at the time of purchase and the current market price of the new replacement spa.
Owner will be responsible for any non-standard costs of spa removal and replacement, such as spas located in a vault, spas located on a balcony or deck where a crane is required, or decking repair or replacement. After six months from the original spa purchase date, Owner will be responsible for all costs for removal and replacement of the defective product, dealer mileage charges, shipping costs of replacement product, and delivery. In the event of a structure or frame failure after three years from the original spa purchase date, the defective spa must be sent to your authorized Bullfrog Spa dealer for repair at the Owner’s expense. In some situations, the servicing dealer or Bullfrog may
charge Owner a reasonable service fee.
Bullfrog reserves the right to use either new or reconditioned replacement components. Any repair or replacement component or spa does not receive new or extended warranty coverage but is covered only under the remaining portion of the original product’s warranty term.
To obtain warranty service, contact your authorized Bullfrog Spas dealer and submit proof of purchase. The proof of purchase requirement may be waived if Bullfrog’s or the dealer’s records can confirm the original spa purchase date and that you are the original purchaser. Any defective spa or component sent directly to the dealer for warranty repair must be pre-authorized by the dealer or  Bullfrog and must be freight prepaid. Return freight will be paid by Bullfrog on all warranted components and spas, excluding any spa returned that is more than three years after its purchase date. If the entire spa is returned to the dealer for repair, all costs of removing and re-installing the spa at Owner’s location will be the responsibility of the Owner. To the maximum extent permitted by
applicable law, repair or replacement, as described above, shall be Bullfrog’s sole liability and your sole and exclusive remedy for any breach of this Limited Warranty.

EXCLUSIONS

This Bullfrog Spa Limited Warranty is void in the following circumstances:
 The spa has been subject to alteration, neglect, misuse or abuse, or to alterations that cause the damage.
 Damage is caused by repair or maintenance work that has been attempted or done by anyone other than an authorized agent of Bullfrog.
 The spa has been used in a non-residential or commercial location (including where a spa may be used by multiple residents of an apartment or townhome complex) or in any way for which it was not designed.
 Damage is caused by an act of God (fire, earthquake, natural disaster or any other external cause), animal, or by any action or omission attributable to you.
 Damage is caused by the addition or use of any non-approved mechanical or electrical component, or chemical substance.
 Damage is caused by shipping, moving, mishandling, improper installation or electrical hookup by someone other than an authorized agent of Bullfrog.
 Damage to the spa shell is caused by excessive heat build- up due to failure to properly cover the spa when it is empty of water or exposed to direct sunlight or other weather conditions.
 Damage is caused by operating the spa outside the water temperature range of 40°F-110°F (4°C-43°C).
 Damage is caused by improper maintenance of spa water chemistry or by allowing undissolved spa chemicals to lie on the spa’s surface.
 Damage is caused by failure to install, maintain and operate the spa in accordance with the recommendations contained in the Bullfrog Owner’s Manual, Pre-Delivery Guide or any other printed instructions, notice or bulletin from Bullfrog.
Any person or company may perform necessary maintenance or repairs on a Bullfrog spa. However, any damages caused by you or anyone other than Bullfrog or its authorized agents are not covered and may void this Limited Warranty.

LIMITATIONS

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS LIMITED WARRANTY STATES BULLFROG’S SOLE LIABILITY AND OBLIGATION FOR ANY SPA PROBLEMS OR MALFUNCTIONS AND FOR ANY WARRANTY BREACHES AND THIS LIMITED WARRANTY TAKES THE PLACE OF ALL OTHER WARRANTIES, CONDITIONS AND OTHER TERMS NOT SET OUT IN THIS LIMITED WARRANTY, WHICH ARE EXPRESSLY EXCLUDED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTIES (SUCH AS IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) ARE LIMITED TO THE STATUTORY PERIOD OR THE DURATION OF THE APPLICABLE WARRANTY STATED ABOVE, WHICHEVER IS SHORTER. NO AGENT, DEALER, DISTRIBUTOR,
SERVICE COMPANY OR OTHER PARTY IS AUTHORIZED TO CHANGE, MODIFY OR EXTEND THE TERMS OF THIS LIMITED WARRANTY IN ANY MANNER WHATSOEVER. THIS LIMITED WARRANTY TERMINATES UPON TRANSFER OF SPA OWNERSHIP.

DISCLAIMERS

NOTHING IN THIS LIMITED WARRANTY EXCLUDES BULLFROG’S LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY BULLFROG’S NEGLIGENCE, FRAUD OR FRAUDULENT MISREPRESENTATION, AND ANY OTHER LIABILITY WHICH CANNOT BE EXCLUDED BY LAW.
EXCEPT AS SET FORTH IN THIS LIMITED WARRANTY OR OTHERWISE REQUIRED BY APPLICABLE LAW,BULLFROG AND ITS AUTHORIZED AGENTS SHALL NOT BE LIABLE FOR: (A) ANY PERSONAL INJURY, DEATH, OR DAMAGES TO PROPERTY; OR (B) ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE, LOSSES OR COSTS, ARISING OUT OF THE SPAS, BULLFROG’S OR ITS AGENTS’ PRODUCTS
OR SERVICES, OR ANY DEFECT COVERED BY THIS LIMITED WARRANTY, INCLUDING WITHOUT LIMITATION, LOSS OF USE OF THE SPA AND COST FOR REMOVAL OF DEFECTIVE PRODUCTS, EVEN IF BULLFROG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
EXCEPT AS REQUIRED BY LAW, THE TOTAL LIABILITY OF BULLFROG AND ITS AUTHORIZED AGENTS TO YOU OR THIRD PARTIES ARISING OUT OF OR IN CONNECTION WITH THIS LIMITED WARRANTY, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY OR OTHERWISE SHALL NOT EXCEED THE ORIGINAL AMOUNT PAID BY YOU FOR THE DEFECTIVE
PRODUCT. COVERAGE UNDER THIS LIMITED WARRANTY SHALL COMMENCE ON THE ORIGINAL DATE OF PURCHASE AND WILL NOT EXTEND FOR ANY REASON WHATSOEVER BEYOND THE STATED TIME PERIOD(S).

LEGAL RIGHTS CONSUMERS

The following applies only if you qualify as a consumer. This Limited Warranty gives you specific legal rights in addition to your statutory rights under applicable consumer protection laws. These statutory rights may vary depending on the laws of your country of residence and are not affected by this warranty.
Some jurisdictions do not allow limitations on, or exclusions of, certain implied terms and conditions, or liabilities. In those cases, this Limited Warranty does not affect, limit or exclude any statutory rights you may have. Prompt return of a completed warranty registration form will help protect your warranty rights. Registration requirements do not apply to residents of jurisdictions where prohibited by law.

GENERAL

Rights of Third Parties

A person who is not party to this Limited Warranty may not enforce any term of this Limited Warranty under the Contracts (Rights of Third Parties) Act 1999.

Invalidity

If a competent court or administrative body finds that any provision of this Limited Warranty is invalid illegal or unenforceable, it will be excluded from the warranty and the rest of this Limited Warranty shall remain unaffected and in force.

Assignment

You may not assign, transfer, mortgage, charge, subcontract, delegate, declare a trust over or deal in any other manner with any of your rights and obligations under this Limited Warranty. 

GOVERNING LAW AND JURISDICTION

This Limited Warranty, and any non-contractual obligations arising from or connected with this Limited Warranty, is governed by and construed under Dutch law, without prejudice to any rights you may have under applicable mandatory laws. You and Bullfrog irrevocably agree that the court of Amsterdam have exclusive jurisdiction to settle any dispute (whether contractual or non-contractual) arising out of or in connection with this Limited Warranty, including as to its existence, validity or termination, unless mandatory applicable laws grant you the right to opt for dispute resolution by a court that would otherwise have jurisdiction under the applicable law.

Záruka sa konkrétne vzťahuje na čerpadlo (čerpadlá), ohrievač, riadiaci systém (vrátane poistiek), FilterCap™ a ďalšie mechanické vybavenie Bullfrog.

Chybné komponenty, ktoré sa dajú ľahko vybrať z vírivky a ktoré môže zákazník ľahko vymeniť a nevyžadujú špecializované nástroje alebo znalosti alebo nespôsobujú problémy s osobnou bezpečnosťou, z ktorých všetky sa považujú za ľahko odstrániteľné komponenty, budú bezplatne opravené alebo vymenené u vášho autorizovaného predajcu Bullfrog Spa alebo zaslaním chybných komponentov spoločnosti Bullfrog. Kryt vírivky Patio Performance™

Spoločnosť Bullfrog poskytuje záruku na krytie vírivky Patio Performance na chyby materiálu alebo spracovania po dobu 3 rokov od pôvodného dátumu nákupu vírivky.

Kúpele

  • Rok 1: 100% výmena komponentov a pokrytie práce.
  • Rok 2: 100% výmena komponentov a pokrytie práce.
  • Rok 3: 100% výmena komponentov a pokrytie práce.

Systém osvetlenia

Spoločnosť Bullfrog poskytuje záruku na systém osvetlenia interiéru a exteriéru vírivky na chyby materiálu a spracovania po dobu jedného roka od pôvodného dátumu nákupu vírivky. Chybné komponenty, ktoré sa dajú ľahko odstrániť z vírivky, ako je vonkajšia LED žiarovka (vrátane nástenného svietnika), ktoré sa považujú za ľahko odstrániteľné komponenty, budú bezplatne opravené alebo vymenené u vášho autorizovaného predajcu Bullfrog Spa alebo zaslaním chybných komponentov spoločnosti Bullfrog.

Audio systém

Spoločnosť Bullfrog poskytuje záruku na zvukové systémy na chyby materiálu a spracovania po dobu jedného roka od pôvodného dátumu nákupu vírivky.

Ozónový systém

Spoločnosť Bullfrog poskytuje záruku na ozónový systém proti chybám materiálu a spracovania po dobu jedného roka od pôvodného dátumu nákupu vírivky.

Zariadenie

  • Záruka sa konkrétne vzťahuje na čerpadlo (čerpadlá), ohrievač, riadiaci systém (vrátane poistiek), SnapCaps™, FilterCap™, iné mechanické vybavenie Bullfrog a netesnosti z akéhokoľvek komponentu alebo vodovodnej armatúry umiestnenej pod plášťom vírivky.
  • Na elektrické a mechanické zariadenia s príslušným potrubím a armatúrami sa vzťahuje záruka na chyby materiálu a spracovania päť rokov od dátumu nákupu.
  • Chybné komponenty, ktoré sa dajú ľahko vybrať z vírivky a ktoré môže zákazník ľahko vymeniť a nevyžadujú špecializované nástroje alebo znalosti alebo nespôsobujú problémy s osobnou bezpečnosťou, z ktorých všetky sa považujú za ľahko odstrániteľné komponenty, budú bezplatne opravené alebo vymenené u vášho autorizovaného predajcu Bullfrog Spa alebo zaslaním chybných komponentov spoločnosti Bullfrog. Táto záruka sa nevzťahuje na audio systémy, systém čističky ozónu a vnútorné a vonkajšie systémy osvetlenia kúpeľov.

Skriňa EternaWood

  • Záruka sa konkrétne vzťahuje na rohy skrinky, dvere a bočné panely a lisovanú základňu vírivky.
  • Časti skrinky EternaWood (rohy, dvere, bočné panely) a EnduraBase™ majú záruku na degradáciu a praskanie po dobu piatich rokov od dátumu nákupu. Defektívne položky budú vymenené za podmienok tejto záruky.

Terapeutický systém JetPak

  • Záruka sa konkrétne vzťahuje na trysky, akékoľvek netesnosti z prúdových armatúr JetPak a všetky inštalatérske práce JetPak.
  • Inštalatérsky systém JetPak poskytuje záruku päť rokov od dátumu nákupu.
  • Dostupnosť farieb pri náhradných a náhradných dieloch JetPaks je zaručená minimálne jeden rok. (Dostupnosť farieb po jednom roku závisí od dopytu na trhu a dostupnosti farieb pre Bullfrog.)

Povrch škrupiny

Spoločnosť Bullfrog zaručuje, že povrchová úprava kúpeľov Bullfrog Spa série R nepraskne, nepokrčí sa, neodlupuje sa ani nedelaminuje po dobu piatich rokov od pôvodného dátumu nákupu vírivky.

  • Warranty specifically covers the pump(s), heater, control system (including fuses), SnapCaps™, FilterCap™, other Bullfrog mechanical equipment, and leaks from any component or plumbing fitting located beneath the spa shell.

  • Defective components that are easily removed from the spa and that can be readily replaced by the customer and do not require specialized tools or knowledge or create personal safety issues, all of which are deemed Easily Removed Components, will be repaired or replaced free of charge at your authorized Bullfrog Spa Dealer or by sending the defective component(s) to Bullfrog. This warranty excludes audio systems, the ozone purifier system, and the interior and exterior spa lighting systems.

EternaWood Cabinet

  • Warranty specifically covers the cabinet corners, door and side panels, and the molded spa base.
  • EternaWood Cabinet sections (corners, doors, side panels) & EnduraBase™ are warranted against degredation and cracking for five years from purchase date. Deffective items will be replaced under the terms of this warranty.

JetPak Therapy System

  • Warranty specifically covers the jets, any leaks from JetPak jet fittings, and all JetPak plumbing.
  • JetPak plumbing System warranted for five years from purchase date.
  • Color availability on replacement and aftermarket JetPaks is guaranteed for a minimum of one year. (Color availability beyond one year is dependent upon market demand and availability of color to Bullfrog.)

Lighting System

Bullfrog warrants the Interior and Exterior Spa Lighting System against defects in materials and workmanship for one year from the original spa purchase date. Defective components that are easily removed from the spa, such as the exterior LED bulb (including sconce), which are deemed Easily Removed Components, will be repaired or replaced free of charge at your authorized Bullfrog Spa Dealer or by sending the defective component(s) to Bullfrog.

Audio System

Bullfrog warrants Audio Systems against defects in materials and workmanship for one year from the original spa purchase date.

Ozone System

Bullfrog warrants the ozone system against defects in materials and workmanship for one year from the original spa purchase date.
